Going on long holiday before FLR(M)

Post by 777GE90 » Sat Aug 05, 2023 10:49 pm

Hello, my wife is due to apply for her FLR (M) in Jan 24 and is on a 5 year route. She wants to go on a long trip home before then.

She was thinking of flying back home for around 1.5 months (i.e. from early Sept to mid Oct).

However, I wanted to check if this will cause us any issues with her visa as we have heard people saying don't leave the UK for longer than 28 days so a little confused what the requirements are or if there is any bad implications with a longer holiday.

Previously, me and my wife have been out of the UK for a 2 week holiday abroad.

With this 1.5 month trip, my wife will initially fly out with her and the baby and I will join her in the last two weeks (or first two weeks) as I can't get time off work for that long.

Is there any issue with leaving the UK for such a long period of time, e.g. does it take days away from ILR or anything like that? I don't want to be in a situation where we have to apply for FLR(M) twice or anything like that.

There is nothing to worry about her visa. There is no absence requirements on spouse visa route. The basically means she can be out of the UK on holidays without such travels ordinarily counting against her.

Thanks for confirming, do you know why some people say don't go for longer than 1 month, is that like an old requirement or just misinformation?

There is no longer such a requirement for points based work visas, not family visas, for at least 10 years.

Stop listening to other people.
