Divorced BC applying dependent visa for new spouse

Post by rk235 » Fri Aug 18, 2023 3:12 pm

Hi,
I have acquired British citizenship through naturalisation in April 2022. My first marriage ended and got legally divorced in India. My previous wife UK dependent visa expired in DEC 2022. I am planning to marry now and bring my new spouse to UK. I have few queries for which i need clarification.

1. Which type of visa should I apply from India ( family member visa outside UK) ?
2. Should i have to include divorcee documents of my previous marriage when applying for new spouse visa ?
3. Max duration of dependent visa i can apply. ( I prefer for 5 years visa as i can save on visa renewal cost)
4. How long will it take to grant dependent visa if applied from India ?

Thanks,
RK

1. Spouse settlement visa provided you meet the financial requirements and your spouse meets the English A1 requirement. https://www.gov.uk/uk-family-visa/partner-spouse

2. Yes, you have to provide evidence that you wwre free to marey. Even more so as you have previously had a dependent on a visa. Ptesumably ypu informed HO of the relationship break down and the ex spouse has left the uk?

3. It is an initial visa for 2 years and 9 months. You cannot apply for a 5 year spouse visa.

4. It can take up to 6 months. Sometimes longer.

Thanks for your quick reply.

<<Presumably you informed HO of the relationship break down and the ex spouse has left the uk?>>
No, I haven't informed HO. I wasn't aware that i should inform my relationship break down. May i know the process how i should inform HO ?

Ex spouse has left UK in Jan 2020 and her visa expired in DEC 2022. We got mutual consent divorcee approved in OCT 2022 in India.
