Naturalization (MN1) for my son

Post by tempkd10 » Wed Jun 26, 2024 3:26 pm

Hi,

I will be applying for Naturalization (MN1) for my son.

I have got my British citizenship in June 2022. After ILR - SET LR)
My son got his ILR (SET LR) in 1st week of June 2024.
My wife got her ILR (SET LR) in 2nd week of June 2024.

I have got below queries, could someone please answer it -

1. TYPE OF VISA / APPLICATION:
Apply for registration of a child under 18 as a British citizen

I think this is correct option selected.

2. Choose which category to apply under. You are a child under 18 and: You were born outside the UK
Other - apply at the discretion of the Home Secretary

I think this is correct option selected.

2.a

Children who have lived in the UK for more than 10 years

Children will come within this category if:
• the child is in the UK lawfully
• the parents are in the UK lawfully
• both parents give their consent to registration (unless good reasons are provided)
• there is no reason to refuse on character grounds.

I think on above grounds he should be applicable for British citizen and can apply earlier rather than waiting for 1 year after ILR application. Right ?

3. Are either of the parents of the child (as stated in this application) applying for naturalisation as a British citizen on an AN form? No

Father
Does your parent or legal guardian share your address, telephone number and email? Yes

mother
Does your parent or legal guardian share your address, telephone number and email? Yes

I have provided my email address and phone number for my son application initially. so I have said yes for both above option.
Let me know if that is fine.

4. Date you first arrived in the UK or British overseas territory
October 2011 (Arrived first time in UK, Later they have gap of 6.5 months gap in 2013-2014)
They have applied for ILR (SET LR) based on first date as June 2014.

So I guess I have to provide the first date. (October 2011). Please confirm.

5. Grandparent details
Provide details of your grandparent from whom your mother or father derived British citizenship by descent.
This question is not application for my son.

Then we have two option - I do not know these details or provide grand parent details.
What should I do ?

6. Referee - Now he is in secondary school from last 2 years but they are asking that teacher should know them for at least 3 years.
So can I give the other referee details. (Ex colleague who is director of his company - contracting)

How does the referee know the applicant? Ex-Colleague
Note - for my British citizen application I have mention him as Ex-Colleague.

He is also my friend. so should I mention Ex-Colleague and Friend or just Ex-Colleague ? Please confirm.

6.a

What is their profession? question is not in MN1 form. It used to be in AN form earlier in 2022.
so do i need to mention that he is director for his company or just leave it.

7. Have you made any previous UK immigration applications in the UK or abroad?
(Required)
This includes applications for asylum in the UK.

Should I give details of his ILR here. (last visa)

8. Have you previously made any other UK immigration applications in the UK or abroad?
Do I need to provide previous family visa / dependant visa details or I can say NO here.

9. Declaration

will it be the applicant or I am a representative of the applicant and have been authorised to act on their behalf and have discussed and
confirmed the contents of this application with them.
Which one should i select.

Thanks in Advance.
Thanks and Regards,
DK

I will be applying for Naturalization (MN1) for my son.
Children are registered, not naturalised, if the child is under 18.
1. TYPE OF VISA / APPLICATION:
Apply for registration of a child under 18 as a British citizen

I think this is correct option selected.
Correct
2. Choose which category to apply under. You are a child under 18 and: You were born outside the UK
Other - apply at the discretion of the Home Secretary

I think this is correct option selected.
Correct.

Right ?
Children do NOT have to wait 1 year on ILR if one parent is British and the other holds ILR.
3. Are either of the parents of the child (as stated in this application) applying for naturalisation as a British citizen on an AN form? No
Fine.
Father
Does your parent or legal guardian share your address, telephone number and email? Yes

mother
Does your parent or legal guardian share your address, telephone number and email? Yes

I have provided my email address and phone number for my son application initially. so I have said yes for both above option.
Let me know if that is fine.
Fine.

Fine
5. Grandparent details
Provide details of your grandparent from whom your mother or father derived British citizenship by descent.
This question is not application for my son.

Then we have two option - I do not know these details or provide grand parent details.
What should I do ?
Ignore, not relevant to his application. Just put N/A
6. Referee - Now he is in secondary school from last 2 years but they are asking that teacher should know them for at least 3 years.
So can I give the other referee details. (Ex colleague who is director of his company - contracting)
You need a professional referee who is on the list as one of the referees, who can be of any nationality and must know the child. The second referee must be British and over 25.
How does the referee know the applicant? Ex-Colleague
Note - for my British citizen application I have mention him as Ex-Colleague.

He is also my friend. so should I mention Ex-Colleague and Friend or just Ex-Colleague ? Please confirm.
Family Friend is what you state. He is NOT your son's 'ex colleague'.
6.a

What is their profession? question is not in MN1 form. It used to be in AN form earlier in 2022.
so do i need to mention that he is director for his company or just leave it.
Just complete what is asked for.
7. Have you made any previous UK immigration applications in the UK or abroad?
(Required)
This includes applications for asylum in the UK.

Should I give details of his ILR here. (last visa)
All visas.
8. Have you previously made any other UK immigration applications in the UK or abroad?
Do I need to provide previous family visa / dependant visa details or I can say NO here.
You only need to answer this one, listing all visas.
9. Declaration

will it be the applicant or I am a representative of the applicant and have been authorised to act on their behalf and have discussed and
confirmed the contents of this application with them.
Which one should i select.
Applicant. A representative is like a solicitor or immigration advisor.

I suggest you read the MN1 guidance notes, if not already done.

Hi,

I have got 2 further queries -.

1. In parent consent form both parents has to sign. (page 1)
do child also need to sign in page 3 of the same form. (which says as below)

Child’s consent where they are making an application on their own
behalf
I ________________________________________________ (name in block letters)
apply for registration as a British citizen and attach the consent of my
father/mother/guardian to this application

2. In the document list -

A letter of consent from Mr xxxxxx parent(s) or legal guardian(s)

The letter must:
give their full names and addresses
say that they agree to let you apply for a British citizenship

If you have more than one parent or legal guardian, they must both sign the letter and
confirm that they agree to what it says. If you only have one parent or legal guardian they
must explain why the other parent is unable to consent e.g. whereabouts unknown, no
contact since MM/YYYY.

Does it refer to the same parent consent form as above.
If yes then above form does not have address to it . does that mean we have to add the address to it.

If no, does that mean we have to add 1 more letter and provide above details.

Please confirm on both queries.

Thanks and Regards,
DK

In the case of children only the parents' consent is required, children can't give consent.

You can use the format from the MN1 PDF form, Section 7 Page 27 - only the parents' sections 7.1/7.2 - fill in and scan with the other documents.
https://assets.publishing.service.gov.u ... 24__1_.pdf

This is a normal procedure.
This is just my opinion as a member of this forum and does not constitute immigration advice.
Please do not send me private messages asking for advice.
