Applying for Humanitarian Protection While on Skilled Worker Dependent Visa

Hello everyone,

I'm seeking advice on a situation involving my family’s current immigration status in the UK.

Background: My spouse holds a Skilled Worker visa (Tier 2) in the UK, and I am here as a dependent. We have a young child with significant health issues that require ongoing, specialized treatments (still hospitalised since birth) unavailable or unaffordable in our home country.

My Questions:
  • Impact on Current Visa Status: If we apply for humanitarian protection due to our child’s medical needs, will this immediately affect or cancel our current Skilled Worker and dependent visas?
  • Status if Application is Rejected: If the humanitarian protection application is unsuccessful, would this impact our ability to remain in the UK under our current visa status?
  • Fees for Humanitarian Application: Are there any application fees, Immigration Health Surcharge (IHS) fees, or other charges for applying on humanitarian grounds? And would we be eligible for a fee waiver due to financial hardship?
  • Additional Impacts: Is there anything specific we should keep in mind to avoid complications with our Skilled Worker conditions while exploring this humanitarian option?
Any insights, especially from anyone who’s been through a similar situation, would be greatly appreciated. Thank you!

Why not simply stay on the current visa? Medical care is free without any issues.

I don't believe Humanitarian Protection is what you are seeking to be honest, based on your circumstances.
