PBS Dependent Extension after main applicant got ILR

Post by jonny0506 » Sat Nov 16, 2024 1:20 pm

Hi all,

I will soon, hopefully, get my ILR Set(o).
My wife and son, however, are on Skilled Worker Dependent visas expiring in December 2024.

Hence, I'd like to apply for their extension pretty soon. I have a few questions in relation to their extensions.

1. They only had been in UK for 6 month, so they would ideally need to have this dependent visa for another 4.5 years in order to get ILR. I know from various forums, they can only apply for 3 years, and then again, extend for another 3 years. When extending for a 2nd time, does Sponsor Licence and/or CoS of current employer need to be active(as in NOT expired yet)? What happens if I change my employer?

2. Are we better off with Family visas once I get my ILR? It's already extremely expensive to get visas and pay IHS fees, but Family visa is even more expensive than Dependent visa.

3. As we are travelling end of December, is it ok for them to apply for extension from outside the UK? They can submit their application before expire and book appointment in our home country?

When does your visa expire?

What does the approvale letter/email say is the validity of your dependents visas?

All BRP cards expire in December so unclear what their actual visa duration and expiry is.

1. You are free to change employer. Foe a further extension, you simply use rhe last cos details you had before getting ilr. Note that they cannot get a 3 year extension before you get ilr.

2. No need to change visas.

3. An application outside rhebuk is a new entry clearance visa. An extension is applied for within the UK.

When exactly are you applying for ilr?

Thank you for such quick response!

Visa expiry is 26 December, as stated in my BRP. It's not because of BRP cards expire in general.
Same for dependent validity - 26 Dec.

I booked an appointment for ILR in London for 20 Nov, Priority 5 day, so hoping to get it end of November.

1. Thanks, noted. So, can they submit their application as soon as I get approval letter from HO about my ILR?

2. Great.

3. That's a bit of a shame. Any evidence of this in official websites? What are the consequences if they apply for new entry clearance? Would that just be rejected?

Also, if we apply for extension from within the UK, how long does it usually take? As we were planning a trip by end of December.

Thanks for help!

1. Yes, they can submit any time now but their applications will only be considered and processed after your ilr is granted.

3. If you hold ILR, they can't apply for a Skilled Worker dependent visa from outside the uk. They will only have the option of apply for a settlement visa, which is more expensive, valid for 2.5 years and you must meet the financial requirements and your spouse must meet the English A1 requirement.

How long it takes within the uk depends if you apply using priority or super priority and assuming your ILR application is not delayed. If you apply for their visas using standard service, it is about 8 weeks.

I have a few more questions regarding Dependent extension applications please.

My wife was able to start application via smartphone app, because she has BRP. However, my son didn't receive his BRP, because it was less than 6 month until end of my SWV when he applied and he only has a visa stamp until 26 Dec.
So his application is via a different link/application portal.

1. Shall they both apply via non app, so that they are processed together? Or they can apply separately and they will still be processed at the same time?
2. I saw some posts that there is no Priority service when applying using app? So she could wait up to 8 weeks. Is this true?
3. I also saw some YouTube videos where people got approval within a few days, if they used an application via phone. How is the timeline decided?

What would be the best approach here please?

Anything?

Can we choose to use normal application for both wife and child? so that they are processed at the same time and also be able to choose priority option? Based on https://www.gov.uk/faster-decision-visa ... ide-the-uk , they can't choose priority if using ID check app.

Thank you
