Decline to Renew

Post by MrBoss » Tue Feb 04, 2025 1:10 pm

2 Questions please ...After 2 years Sponsoring a worker. It is due to be renewed. As an employer, i would prefer not to renew this worker. Can i give 2 or 4 weeks notice and let Sponsorship laspe ?
Should Contract of Employment be fixed term to match the CoS ?

You give notice based on the terms of the employment Contract. This has nothing to do with immigration other than the worker cannot stay past the visa expiry date of their visa, regardless of how long is left on the notice period.

People with time limited visas usually have a fixed term contract yes.

I think your only pitfall is the notice period as you cannot keep anyone without current right to work on your payroll.

My only suggestion would be that if the employee notice period is longer then his current visa you should offer payment in lieu of notice. Most employment contracts should allow this.

As for previous comments, I used to be tier 2/skilled worker sponsored in the past and had open ended contracts with both my employers. Contact types are not immigration subject.
