How soon to apply for Naturalisation?

Hi,

So, here is the situation and need some advice, please.
  • Parent A got ILR through GTV (3 years route) on 13/6/2022
  • Parent B got ILR on 14/2/2025
  • Children <18 and >18 got ILR on 14/2/2025 as well
Questions:
  • If both parents have ILR, who can apply for naturalisation immediately? <18 OR >18 living together with parents.
  • When can Parent A apply for naturalisation? The 5 years completed on 13/6/2024
  • When can Parent B apply for naturalisation?
  • Who can apply for naturalisation (<18 or >18) if any one of the Parents has a British Nationality?
  • Can you please advise the correct forms for the above?

If both parents have ILR, who can apply for naturalisation immediately? <18 OR >18 living together with parents.
Children under 18 can apply immediately if are UK born. Children born abroad can apply when at least one parent is also applying. Children over 18 have to wait the full 12 months on ILR before they can apply for citizenship.
When can Parent A apply for naturalisation? The 5 years completed on 13/6/2024
When Parent A has 5 years residence and at least 12 months on ILR.
When can Parent B apply for naturalisation?
When Parent B has 5 years residence and at least 12 months on ILR or if they meet the requirements sooner once Parent A is British (after attending ceremony).
Who can apply for naturalisation (<18 or >18) if any one of the Parents has a British Nationality?
Children under 18 if they are born abroad. Children over 18 must wait the full 12 months on ILR because they are adults.
Can you please advise the correct forms for the above?
Form AN for adults, Form MN1 for children. If a parent or parents are applying, you can add children under 18 to the same application. Adult children must apply individually on their own form when they meet the requirements.

There is no concept of dependency after ILR.

If a person has passed their 18th birthday, they need to naturalise and meet all the requirements of am adult, such as waiting for one year after ILR, the absences and physical presence in the UK requirements, and both the English language and LITUK tests.

If the person has not yet passed their 18th birthday, they can register as British citizens, provided that at least one parent either already has or is apply for British citizenship at the same time AND both the child and the other parent have ILR. Obviously they can only do that after one of the parents has completed at least one full year on ILR.

According to the timeline of Parent A, who got ILR through GTV (a 3-year route) on 13/6/2022 and completed 5 years in the UK last June on 13/6/2024, can Parent A apply now or wait until June 2025?

Parent A could have applied in June last year already when 5 years residence was reached.

Parent A can apply now or whenever rhey are ready.

To avoid financial strain, is it possible for Parent A to apply separately and then < 18 can apply separately every month once Parent A has their ceremony done?

A few questions about the Documents Checklist.

Parent A is the Director of the Company formed and registered on 22/4/2024. The Director is not taking any compensation, salary or payments from the Company. The director also works as a Consultant and therefore, also files self-assessment (apart from the Company). Upon asking about the current Job during the Naturalisation application, Parent A mentioned working as a Director and added the Tax reference as well. However, as the company was only formed last year, there is no filling history as of now.

The Document Checklist has asked for the following documents.
  • Passport
  • Degree Certificate for English
  • Proof of Living in the UK (5 years apply)
  • Two Refrees
Questions,
  • The checklist says,
    if you are a Non-EEA National (which I am), you need to include your passport to prove you have lived in the UK for the relevant 3- or 5-year period
    . It also says, that
    if you do not have your passport or it was not stamped when you entered the UK, you need to include letters (for example, from your employer or government department) as proof. Bank statements or household bills are not suitable proof you have been living in the UK
    .

    We have the passport and the stamp of arrival on it. Would that be sufficient or if not then what other documents should we submit?
  • The list didn't ask for any bank statements or HMRC etc for the Job or any relevant proofs of the Director role. Should we submit anything here or should we simply go with the list?
  • Any particular requirements for Referees other than British Nationals, no convictions and one personal + one professional?
  • Any other documents should be submitted by Parent A?

Does your passport have stamps for all your trips? Then just submit that.

Did you select you are self-employed? As your company just started recently you will only be able to provide registration number for the company or similar and explain it's a new company

The British national must be older than 25 years old
  • Any other documents should be submitted by Parent A?

Thanks a million for such a quick response.

We have the passports with entry stamps from the day we entered and left the UK (for vacations). We only selected a Director role and didn't select self-employment. Should we select this or Director is enough because no salary or compensation is taken from the Company?

Also, any other (additional) documents that should be submitted?

If you file for self assessment I think you should select you are self employed. Your passport will be enough as they get stamped. From what I see no other documents required.

Upon choosing self-employed, it says the most recent tax year account statement corresponding HMRC tax returns. Is this the Bank Statements they are asking alongside HMRC tax return? Because before that they said 'Bank statements or household bills are not suitable proof...'.

If yes then do we need to submit statements for the full recent year?

We added another person in the application (Partner/Spouse) who is on the Job and mentioned the current employment. The application only asked for the Tax Reference code and there is no requirement to submit any Bank Statements, HMRC or Payslips.

Should we add any or just follow the checklist?

Don't add what is not required. Payslips and bank statements are not needed. Even being employed is not a requirement.

  • Also, the instructions say
    On the back of the applicant’s photograph, please write their full name and date of birth. The photograph should then be glued into the space aside
    . How to do this if required to be uploaded online?

So, this means we can send these forms to the referees and they can electronically attach their photo, add a signature etc and send us back to upload. Is this correct?
