ILR for spouse & dependent - date query

Post by mattyh83 » Thu Apr 17, 2025 8:10 am

Good morning,

We are coming to the end of our five year spouse visa route with dependent (was aged 13 on arrival, now 18).

They entered the UK on July 6th 2020. We've only left the country once since that date, for approx 30 days (holiday).

The eVisa expires in October 2025.

I am hoping I can get some clarity on potential dates for submitting our application for ILR.

Am I correct in saying the earliest we could apply would be approx 8th June 2025?

However, my wife wants to go back to her home country this summer if possible BEFORE we apply however, so what would be the latest we could apply for ILR - Early October 2025?

Many thanks as always for any help / advice!

M

June sounds about right, which will be within 28 days of completing the 60 months in the UK. That is the earliest date they can apply but they can apply anytime for ILR after that and as long as they have a valid visa

Thank you.

Just a quick question -

Our eVisa expires late October.
We have a holiday abroad booked mid July and returning August 11th (ish).

Is there likely to be any problem re-entering the UK? We plan to fire off our ILR applications as soon as we arrive back from this holiday.

Many thanks for any advice.

No.

You have a valid visa until October, no issues with international travel before it expires.

Thank you for your response.

One last question if I may -

My step-son entered the UK 5 years ago as a child but for the ILR application he is now aged 18.

He has completed the Life in the UK test successfully - but does he also need to do the English language test?
