Parents Visa

Hi Team,

My parents are Indian Citizen and they came to UK on tourist visa and stayed here for 6 months.

My query is when can they come back again to UK. is there any cooling period or any law how many days in a year they can stay.

Thank you for your guidance.

How long did they state in their visa application that they would be visiting the UK? Did they state they were staying for 6 months?

The general rule is not to stay in the uk for more than 180 days in a 12 month period. They cannot be spending more time here than in their home country try, as then they are residing under the guise of a visitor visa and not visiting.

This is an important question. If they stated that they were planning to stay for a shorter period in their application form and they actually stayed for six months, even if they did not overstay, a future visa application may be rejected on the grounds of dishonesty.

To be frank, a six month stay in the UK does not sound like a "visit". It sounds like residence in the UK and not a visit.

Unlike the EU, which puts a specific number of days you have to be outside before returning to the Schengen Zone, the UK looks at a much wider picture.

Paragraph 4.2(b) of Appendix V (for visitors) of the UK Immigration Rules states that the applicant "will not live in the UK for extended periods through frequent or successive visits, or make the UK their main home.

As CR001 has advised, your parents need to spend at least as much time in their country of habitual residence as they did in the UK, but that is only the minimum time they should remain in their country of habitual residence. Again, look at the statement of the Rules above about "frequent and successive visits".
