MN1 submission for chidlren born in UK with ICT Dependent

Hi,
I was in Tier2 ICT Visa from 2015 to 2019 and my children were born in UK by then. We returned to our home country after ICT Visa expierd and as per the previous immigration rule, underwent 1 year cooling off period and returned back in Skilled Worker Visa route in 2021. Now i recieved my ILR in 5 year route. Can I apply MN1 for my children, who were born in UK, but they were born in my other visa route? Also we have a gap of 1.5 years between my 2 visas (we were in home country). Will this have any effect? Also our children dependant visa expiers in mid-april. Should I extend the visa? or since they were born in UK, can directly go for MN1? Appreciate your opinions. Thanks

Yes you can apply now.

Their visa route is irrelevant.

The period of absence is irrelevant.

Thank you very much for the reply.To check on this further, their dependent visa expires on mid-April. If i apply for MN1 and without extending their dependent visa, would it be ok. Will that not make them as Oversytayer?

They will be overstayers yes but it has no effect on the mn1 application.

They won't be entitled to free nhs, so get private medical insurance if you dont already have it.
