British citizenship

Post by isoprem » Sat Oct 24, 2009 2:09 am

British citizenship

I am a British citizen and I have got the citizenship through my mother who took the citizenship by birth (born and lived in the UK for about 4 years); however, I have never went to the UK before (because of my work) and I got my citizenship as per the amendment for the Act 1981.

My question is if it is possible to apply for British citizenship for my wife and daughter? Knowing that I got married and I got my daughter before becoming British citizen, and m daughter now is 3+ years, in addition, my daughter has a cerebral palsy (a medical situation) and I can provide official documents regarding this issue, and the treatment for such issues is already in advance stage in the UK.

Summary:
-I am British Citizen through my mother
-I have got married before I got the citizenship
-My daughter have been born before I got my citizenship and she is now 3+ years old
-My daughter has a cerebral palsy medical issue

Your help is essential an important for me and my family.
Thanks to all in advance

You basically asked this question 2 years ago.

The situation has not changed with regards to your wife. She would still have to apply for a settlement visa on the basis of you moving to the UK and after 3 years (and another visa application..) she is likely to be entitled to apply for British Citizenship.

I don't believe the situation has changed with regards to your daughter either, though happy for someone more knowledgeable to correct me.

at first i would like to thank you for your prompt reply.
you are right djb123, i have asked this question about 2 years ago; however, i posted it again because my daughter medical situation wasn't identified clearly at the time of first post.
so i am wondering if this medical issue will facilitate getting citizenship for my daughter.
as for my wife, is there any posible way to start the procedure while we are not living in UK becaseu of my remote work requirment in Middle East (to move to UK means i have to quite my current work).

so does the above make any change in citizenship procedure or facilitate things?

What are you trying to achieve? British passports for the rest of your family whilst you are living and working in the Middle East with no intention of moving to the UK?

If so it isn't going to happen, and any changes to the the citizenship procedure will make it harder not easier.

That's not what I am trying to achieve.

as I have mentioned before my daughter has a medical issue which can be treated in the UK in advance way, so I am intending to move my family to the UK for that (in first place), however, medical treatment for my daughter as a UK citizen will different from being a non-UK citizen, besides, some enhancement programs will be very expensive for non-UK citizens. So my intention is to move my daughter to the UK as a citizen to start the treatment efficiently and immediately.

In addition to the above, I am intending to settle down in the UK with my family.

My other question is that there is a chance that during the first few years after moving to the UK I won't be there with my family, so does this affect the Indefinite Leave To Stay? Or affect other citizenship procedures?

I know my situation is somehow complicated.
Many thanks for your intention and advice.

This might seem harsh but having never paid towards the NHS service in the UK you want to move your family here just to use it?

Firstly I believe entitlement to the NHS is based on residency not on nationality, but depending on the local health service they may want you to be resident here for a certain amount of time before you can get free non-essential treatment. If you are not planning to settle here it may make it difficult for your wife/daughter to get a settlement visa in the first place as the visa is issued so that they can be with you. Assuming they get the visa in the first place when they come to renew their visa after two years it may be difficult if you haven't been living in the UK.

Many thanks djb123 for you help

As a matter of fact I was planning to move and settle permanently in the UK but it was long term planning which is changed to short term planning due to the medical issue once I come to know that this movement will help my daughter.

Sorry to hear about your daughter, i hope you will find solution that works for you daughter.
anyway i believe the treatment will be the same for citizen and non-citizen. I am not sure also how long you have been married for, if it is over 4 years then i think your wife and daughter will get Indefinite leave to Enter (ILE) which is the same as ILR. I think you need to show that you are all moving to the UK to qualify.

Though to get ILE your wife would have needed to pass the Life in the UK test first, which you need to be in the UK to do.
