Can I extent my staying after quitting job.

Post by cin » Wed Jan 26, 2011 7:06 pm

Hi everyone,

I've been leaving in UK since October 2003 (4.5 years as student and as work permit holder since 3rd March 2008). The company I work for was sold and job redundancy is likely to happen soon. I'm not very positive that I'll find another sponsor and my only option is to leave the country. I learned I have only 28 days to leave UK once I have no sponsor. It's nearly impossible for me to pack more than 7 years of my life and plan my next destination in only 28 days, even if I start doing it now, it's just a lot to think and to decide.

My question is: Is there any way to extent my stay without being illegal in the country?

Many thanks in advance.

I completely understand you... you've created your life in this country, and now in 28 days you have to leave everything... I find this amazingly stupid and it can ruin peoples lives.

Well, I'm not sure, but you can become a student again perhaps, but it's little time. Do you qualify under any other tiers? Like tier 1? It's still not closed I think.

when is your visa going to expire. if its less than 6 months... then you can stay in this country until your visa expires and not just 2 weeks from the date you are made redundant!!....

regards

Yes, arsenal is right... but you didn't provide that information so we can't know.

It would appear you are also a visa national for visit, so you can't come back again just easily. Otherwise, I think you can just leave and come back again and stay for 3 months to sort things. Then you would be in as visitor, but still, it gives time to sort things.

Best of luck to you. The system is crooked, we as students know it well.
Hope it goes well for you.

Hi Guys,

Thanks for replying.
My visa expires in March 2013. I'm on 5 years work permit scheme. My plan WAS to apply for the Indefinite leave to remain in 2013. I don't want to become a student again. I want more time to sort out my things here before leaving the country. Of course I 'll be coming back to UK as a visitor from time to time to see my friends so I don't want problems with the Home Office.

Would Home Office grant me more time if I write to them? Is it something the usually do?

once ur employer decides to finish ur job, they should write to Homeoffice, then Homeoffice will write to u that u are no more working for ur employer thus u have 60 days to either find a new employer or switch into another category. u must leave uk before xyz date or 60 days from the date on the letter.
If homeoffice has not been informed, then its a gamble.

I think the best bet would be to switch to say, tier 1. Even 60 days isn't enough to do much... especially in this state of poor job market.

With tier 1, u are not dependant on employers, and can switch freely.

I'm sorry to hear about your situation man. The system is really f*cked up.. Look at all the losers with a passport running havoc in the country and look at the situation for people who work hard ! Beauty of this country..

Anyways we made a choice to come here and we're suffering because of that. It's a good eye opener.

I think you should see a solicitor and get some professional advise. Why not ask your boss to help you find another place ? It's worth a shot.

I know how you feel mate. Good luck to you.

Tier 1 might be his best bet if he qualifies... but as you say here, it is really f... up that you work here with no security or anything, once your job ends, you have to pack years of your life and leave like trash... and this fear is always there, until you get ILR etc.

The system is crooked. We have to live with our choices now, and decide to go or stay and fight.
