Spouse visa help

Post by casjoe » Fri Mar 02, 2012 8:07 pm

I want to apply for a spouse visa. My husband (UK citizen) and I (US citizen) were married in the UK in 2007. I returned to the US in 2009 with our first child and pregnant with our second. I now want to return to the UK with both of our children (who both have UK passports).
I have several questions. The first is about the maintenance requirements. My husband is the sole carer for his elderly mother, so other than that he is not employed. He has 11,000 GBP in savings, and more in a joint account with his mother. He does receive some income support and carer's allowance. They own their home outright, and there is enough room for all of us, according to the rules.
I am unemployed at the moment, but would like to try to find work in the UK if/when I'm granted the visa and move back to the UK.
My parents have offered to help by sending $300 a month. Also, the benefits my mother in law receives is used as household income, and would help bear the added costs as well.
Does that sound like it'll be enough to satisfy the maintenance requirements?

Since our kids have British passports, they shouldn't need any sort of visa to stay in the UK, right? And since my husband is a British citizen and so are the kids, will he be able to claim child benefit for them once we're there?

What exactly do they want to see as evidence of accommodation? Are bank statements or utility bills enough?

Thanks in advance for any advice anyone may have to offer.

See also Guidance and 3rd party support.

Kids will not need British visas.
