Tier 1 General Extension - Child - Applying later - Query

I am going to apply for my Tier 1 Extension shortly and was wondering whether i can apply for my daughter's extension separately after 6 months. As she is born in the UK i think she can stay in the UK without a visa.

Can someone please help me with the above query?

Yes you can do that.

She would need a visa if she is travelling out of UK and then returning back.

I just called the home office on 08706067766 and they said that from Feb 29th onwards BRP card is been issued to everyone, even though ur child is 1 year old. In case of children under 6 only photographs are taken and a BRP card is issued.

If the child is born in the UK and the parents dont have ILR or British citizen then the child should be applying for an extension along with the parents. The child cannot be left without having anything, i mean, without a visa.

I want someone to clarify the above for me. If someone has a link from the immigration rules which states that the child should need a visa even though the child is born in the UK, can someone please post the link?

Maybe this has changed recently but the general consensus was that you can leave the child extension if they don't need to travel and apply together for ILR.

This time i again confirmed it and the gentleman explained that it is illegal and it will go into legal ramifications where things might get pretty complex...So they always suggest that the entire family apply together via PEO and if PEO doesn't seem to suit u then apply in post but do apply together..

But as u said that it will be good if Greenie or Vinny has some link to the immigration rule which states that it is legal for the child to stay in the UK without a visa.
