Working while waiting for ILR

Post by tdw197 » Thu Apr 05, 2012 12:52 pm

My wife applied for ILR on set(m) 2 weeks ago, her current FLR runs out on 18/5 (she has been here since jan 2006 on flr x 3).

She works for royal mail and has just received a leter sayign hr employment will be terminated unless she gets a new work permit before the current one expires. looking at the waiting time on here, it may take longer than that.

Now I've looked at the Home Office website and it says your current residence status continues until you have a decision, which to me means that they have no right to terminate he employment and she is allowed to continue workign here.

But, how can we prove this???

Yes. Her leave will be "treated as continuing" under Section 3C, if she made a valid in-time application.
