Tier1 extension granted but total visa length less than 5 yr

Post by ldbright » Sat Apr 07, 2012 2:43 am

My initial tier 1 visa is from 21/04/2009, i applied inside the uk so it's is the actual start point of my tier 1 visa, however, when I extended this month, the extension was given according to the application date, which is to 03/04/2014.

At the time, the CW explained that I will be ok in terms of ilr as I can apply 28 days in advance iN 2014. My concern is, that I have not given total 5 years of tier 1 visa, therefore, I have to go through another extension. Is this different from got 5 years t1 in total but travelled late?

Can someone pls clarify that if my visa is from 21/04/2009 to 03/04/2012, can I still apply ilr base on the 28 days rule? Or I have to go through another extension.

Many thanks.

Thanks for your reply, so even my total number of years is less than 5 under tier 1, I still can apply ilr as it is within 28 days?

How much assurance do you want? Case worker already gave you assurance, the moderator on here gave you assurance, and if you read the ilr guidance then you can see it in black and white.

For others for future reference, when you apply for tier-1 extension then you can request for a slightly longer extension (e.g 2 yrs and 1 month) to cover the gap and allow you to complete the 5yrs fully. That's what i successfully did.
