Hi

Please can somebody help me. I will be applying for BC soon for myself and my son. My sons dad is an EEA National and both my son and I have a 10 year endorsent in our South African Passports.

On form MN1 guidance it states the following

'The child of an EEA national who did not become a British citizen at birth may now have an
entitlement to be registered as a British citizen under section 1(3), if the parent has since
become “settledâ€

Hi thanks

That does not make sense I am afraid - Section 3(1) is for Children born in the UK! My son was born in South Africa.

Can I apply for him as the NON - EEA National who has PR in the country? Just soooo confused

Sorry are you referring to the Section 3 (1) of the British Nationality act 1981?? I was going by the MN-1 guidance booklet from the UK Border Agency.

So do I still need to provide the dads details if I am applying on my own for my son?

Child's father's consent may be required.
