When to apply for ILR

Hi,

I have similar confusion. I could not find clear answer anywhere else. My wife entered in UK on 9th September 2016, her 5 years will be completed on 9th September 2021. But her visa is expiring on 29th December. Can we apply her visa on completion of 5 years (9th sept 2021) or do we have to wait until December?
second question: If we can apply on completion of 5 years, then, can we apply 28 days before 9th sept 2021 (Mid August 2021) or do we have to wait until 9th Sept 2021?

1. Do NOT tag your questions onto other members topics. It is considered rude.

2. Useful to state the visa category of your spouse as different visas have different rules!!

Hi,

Sorry i did not know, as i am new. I thought it would be good to post my question on exiting similar topics.

she is on spouse visa and we are planning to apply for ILR

She can apply no sooner than within 28 days before the 5th anniversary of the date she entered the UK in a spouse visa (not a 6 month fiance visa).

The latest she can apply is the date her visa expires.

sorry i did not know the rules as i am new. i will avoid next time. I posted on timeline as i thought i might get a quick answer as other topics might not be viewed frequently

All members who are online can see the new topics that have been posted. Timeline topics are not for questions, they are for timeline updates only.

Please respect that the forum is not an on demand service. We are all unpaid volunteers with our own work and family committments so will respond to posts if and when we can or choose to.

last question, according to your reply, we can apply for spouse ILR in Mid-August instead of 9th September 2021, correct?

Documents List for ILR SET (M)

Hi,

I tried searching existing topics to find required documents list for ILR SET (M) application but could not find.
My wife is applying for ILR spouse visa after completing 5 years. We just want to confirm the list of document we need to upload with the application. Please let me know the list of the required documents or a link where i can find this information.

Your help will be much appreciated.

thanks for sharing the link for Financial requirements.
if it is possible/available, I am looking for a list of all the documents which are required to upload with the application.
Finance related, only 6 months payslips and employment letter required(my annual income meet the requirement), correct ?

Another tricky question, My previous company was acquired by my current employer on 1st August 2021. My job, contract and Pay remain the same just company name/owner changed. The payslips i am going to attach with the application are from my previous company but employment letter (with all the salary, allowance and bonus information) would be from my new employer.
How should i answer the following question in the application
"Have they been employed by the same employer for the last 6 months prior to the date of application?"

You can find the evidence required in the section that mentions the 'specified evidence' for your category. There is no general list but you will get a list after you complete your application online. Company take over should be viewed as continuous employment with the 'same employer'

i was just thinking that case worker might get confused as payslips would be from different company and employment letter would be from a different company.

To eliminate chances of CW confusion, your clarifying the circumstances that warranted the difference sources of documents can be placed in additional information.
