Updating visa status from ILR to Tier 2 General

Hello,

I will be soon applying for ILR , my current employer is ready to give a letter for my leave absence , however previous employer is not responding to my email so I am not able to get leave absence from previous employer. Will this create a problem? How should I handle this problem? Please advice.

If they are less than 30 days per residence year, do not bother

Below are all the details of the dates of visa , my arrival in the UK and the date I started my job:

31-08-2015 – 30-09-2015 - TIER2 (GENERAL) MIGRANT - Just one month to enter UK and get BRP card

02-09-2015 – 14-10-2016 - TIER2 (GENERAL) LEAVE TO REMAIN - First BRP

Landing in UK 13-Sept-2015

First day at job is 14-Sept-2015

11-08-2016 – 14-09-2019 – TIER2 (GENERAL) LEAVE TO REMAIN - Second BRP

15-09-2019 – 13-09-2021 – TIER2 (GENERAL) LEAVE TO REMAIN - Current renewed BRP

May I please know what is the earliest date on which I can apply for IRL as per above information
There is no gap.

You can apply no sooner than within 28 days before the 5th anniversary of your initial visa issued date, ie 31 aug 2020 minus 28 days.

I am on Tier 2 visa , soon will be applying for ILR.
For English requirement, I have got all the required documents and when I started my registration on Naric website with basic information like name, email,nationality etc and then I got stuck/Confused at one question which have answers in the drop down.

Question asked : Family, Settlement, ILR,and Nationality

I am confused between 2 options : Tier 2 / Family, Settlement and Nationality
After selecting this, there are other dependent questions.

They have mentioned this is very important question. Can you please suggest what option I should select.

In the leave absence excel sheet weather I should just mention 30 days holiday or I will have to give all above details.

What you did is irrelevant. Full days of absence from the UK should be declared

HSBC account has denied to provide stamp and signature on my bank statements instead they said they can provide a letter as a Certificate of Balance which can be used as a proof.

Also the bank statements which they have sent me through post says duplicate on it ? Is it still valid?

Yes. Most often duplicate/replacement postal statements bear such title.

Bank statements if are not on official stationary won't meet the criteria without the stamp & signature. And a balance certificate alone will be frivolous.

On the basis of what seagul raised, a safer option will be for you to try other HSBC branches, tell them is for immigration/HO purpose and out of a couple you should get one that will grant your request.

Some towns only have one branch within their 50-100 miles. However based on the op's current situation where he couldn't be able to get these stamped so these won't be accepted rather the ones he has got and marked with duplicate will be fine (same as said earlier).

I have tried branch as well as calling bank , they denied to sign and stamp instead agreed to give a letter with balance which will have a signature.

1. Better to update your bank, any money lender or the landlord.

2. You are free to work anywhere subject to any written agreement with previous employer

1. Can't think of any at the moment, but if you rent property then letting agency/landlord keep a copy of your visa status, so if that's the case you can inform them and they don't need to do any follow up checks again.

2. No, you are free to change jobs now, but go through your current terms & conditions before resigning or accepting new job... just in case.

If you wish/planning to leave the old employer then ideally to do so amicably as their referencing will gigantically overwhelm your future opportunity
