Dear All, my eea (pr) application has been refused because I didn't provide my ex id. can anybody reply please if I want to do fresh application with my ex id, what is the time limit to send fresh application? Thanks

Jkj I told you before you can make fresh application when you ready there no time limit to make fresh application you can make fresh application any time

Thanks jay ho. But my visa was expired at September. And my solicitor don't want to do appeal. So if I send on 29/11/2017 Where my refusal issued 12/11/2017. Is it will ok? Thanks

Hello! I just joined the Forum today having been following the threads for a while now.

Must you of necessity provide your estranged spouse's Id? Please is there a law that stipulates that you 'must,' thus making it compulsory? Please what does the regulation 21(5) of the EEA 2016 Regulations say. Does it nullifies regulations 17 and 18 of the 2006 Regulations?

Hello. It's sad HO has decided to go on this trajectory to target Non EEAs. In my view what they are doing is against the law. I am of the view that they are resorting to dirty tactics to frustrate people.

Now what does regulation 21 (5) and (6) of the EEA 2016 Regulationis say? It doesn't give them the right to refuse people. Unfortunately, I am a victim of this crude strategy too. At best how do they expert you to convince an estrange spouse for their nationality document, be it passport or ID. Please what do others think of the Regulations 17 and 18 in lieu of these flagrant refusals?

regulation 21 (5) and (6) of the EEA 2016.

"(5) Where an application for documentation under this Part is made by a person who is not an EEA national on the basis that the person is or was the family member of an EEA national or an extended family member of an EEA national, the application must be accompanied or joined by a valid national identity card or passport in the name of that EEA national."

(6) Where—

(a)there are circumstances beyond the control of an applicant for documentation under this Part; and

(b)as a result, the applicant is unable to comply with the requirements to submit an application online or using the application form specified by the Secretary of State,

the Secretary of State may accept an application submitted by post or in person which does not use the relevant application form specified by the Secretary of State.

* May I know if it is possible to equate acceptance to granting you the Permanent residence?
Is the 'acceptance' in (6) in line with accepting submitted documents or rejecting them if they are not sufficient enough for proper determination of an application? I am confused, clarity may help. Thanks.

Hi,
I retained rights in February 2013.
PR applied early Jan 2017.
I sent docs from Jan 2012 to Jan 2017 (5 years various docs prior to my application)
You dont need to wait 5 years after retain rights/divorce to apply for PR.
In the older application form (the one I used) the guide state that I (Only) need to provide evidence from when I retained rights ie: from Feb 2013 to application date but I thought might as well send in 2012 docs as I have them.

Which year did you receive your decree absolute year and month please? My case is very similar to yours. I just want to workout if the 5 years include from decree absolute?
