Tier 2 (General) Dependant Child visa - Rejected

Post by tui2018 » Thu Feb 15, 2018 8:34 am

Hi,

I've just received email from New York visa office that my baby's visa application has been denied.

I'm a tier 2 migrant skilled worker in the uk but chose to have my baby out of the country. Applied for baby's visa as soon as I could only to get a rejection. I'd share the details of the decision as soon as I receive it from the embassy. I've only just been pondering why this rejection cos everything seemed accurate.

Has anyone had this issue before?

Where is the other parent and what is their UK immigration status?

Other parent lives in Canada and no uk immigration status, which is why we chose to have our baby at his residence rather than the uk.
He also provided a letter we added to the application stating that baby needs to travel with me (the mum) since I needed to resume work.

Failing 319H.(f) may be a reason for their refusal.

Hi Vinny,

That applies to ILR applicants I think... it shouldn’t be applicable to tier 2 dependent visa.. what do you think?

Apologies, you may be right. I’d know by weekend.

The quoted Immigration rules refer to a PBS dependant child entry clearance and extension.

So if this is the case, any chance I can appeal on any basis and add spouse application also? Or is the ONLY other alternative to file applications for father and child?

Hi Vinny,

So yeah that was the reason for rejection. Thanks.

Hi tui2018,

I have a similar issue, and I am wondering how you handled this - did you file applications for father and child finally? Was it successful in the end?

Thank you,
Jiao

Hi tui2018 and msjiao,
I am exactly in same situation.
My Childs visa is rejected since my husband has not applied.

How did you go about it?
were your able to get the visa after the father applied ?
