Tier 1 entrepreneur Net job creation calculation

job creation calculation

I have a query related to job creation for Tier 1 entrepreneur visa. Please can someone clarify / help me with the below mentioned query?

One year before I became a director to an existing business, the following jobs existed between 1-April 2016 to 31-Mar-2017
Employees A Full Time (35 hours per week)
B Full Time (35 hours per week)
C Part Time (15 hours per week)
D Full Time (35 hours per week)
E Part Time (8 hours per week)
F Full Time (35 hours per week)

B left the company on 10-June 2016
F Joined the company on 1-June-2016 as Full Time

I joined as a director on 1-April-2017

I have added 2 FT on 15th Nov, 2017 and both have worked for 12 consecutive months

What will be the baseline that I need to consider for calculating net increase in employment?
Will that be 4 Full Time and 2 Part Time or will that be 3 Full Time and 2 Part Time as on 1st April, 2017?

You did not mention whether any employees left before Nov 2018. Assuming none did, you clearly increased a net two jobs. So it does not matter whether it is 4 or 3 FT before you joined.

However, to your specific question, they have never clarified how the NET increase is defined. Having said that, remember it is net increase of JOBS, not employees. So, it depends very much on what jobs the employees have.

And your assumption is correct. None of the added employees left the jobs till Nov 2018.

I have a query regarding job creation calculation for Tier 1 Entrepreneur Visa extension:

I have tried to put an example for this purpose.

Point to note: We are not calculating transitional arrangement

Tier 1 Visa approved date: 19-Feb 2016
Date of Joining the business as director to an existing business 26th April, 2016

Before joining the business 2 jobs existed from 1-April 2015,

employee name: Employee 1
employee name: Employee 2

Employee Name Start Date End Date Full time / Part time
Employee 1 1st April, 2015 30th April, 2016 Full time
Employee 2 1st April, 2015 25th April, 2016 Full time

Joined business on 26th April, 2016

Two jobs were created on 1st Sept, 2016 and Employee 1 continued working without a break

New Employee name: Employee 3
New Employee name: Employee 4

Employee Name Start Date End Date Full/Part time No of months the employee worked
Employee 1 1st May, 2016 30th April, 2018 Full time 24
Employee 3 1st Sept, 2016 30th Aug, 2018 Full time 24
Employee 4 1st Sept, 2016 30th Aug, 2018 Full time 24

Both new and old jobs are full time jobs, minimum worked 30 hrs per week and were paid above minimum national wage

Please can someone let us know the net increase in jobs in the above example?

In my opinion, you don't meet the net increase of two jobs. You have only increased the number of jobs by one.

Given that none of the jobs exist anymore, it is difficult to see how you could meet the job creation criteria now.
