I have been advice by solicitor to put in my ILR application any time from 7/01/2019 which is my 10 years residency date of completion and shouldn’t later than 12/01/2019 for the application to be submitted cos upper tribunal letter date is 31/12/2018. Please help to analysis this suggestion if it’s the right way to go.

Sounds abt right! 14 days within refusal letter.
Submit after you qualify but before the 14 day period as mention in the 39E posted above. As long as you submitted all in time applications I think you’ll be fine. Use the Correct form-SET LR. Start filling it out and get ur docs together.

I’m planning to submit the application by 8 of this month January but I don’t know when the application submition time will start counting under this new service if it when you submit online or when you submit your documents with the service centre?

Hi your 3C has ended on the day your appeal rights exhausted hence you became an overstayer ,usually ,HO will refuse your application as you are 7 days short of your ‘continuous legal 10 year stay in the Uk’.
I had same situation with a bit more gap ,Ho refused it ,lower tribunal refused it too.we asked upper tribunal judge to consder 39e rules and judge clearly said ,39e discounts over staying period but doesn’t cover 3C hence there is no “continuous stay”according to HO requirement for 10; years .

Your luck depends on your case worker . Good luck

Hi,

You should consider having a discussion with your solicitor who understands your situation better than what we read on here. I believe you have a considerable break in your 10 years long residence which may pose a problem of any ILR application been refused. Your situation is tricky and needs careful considerations so that you don't waste limited funds chasing nothing. You have to sit down and calculate how long you have been in the country and the breaks which may be a barrier to your ILR application, then you will be able to plug the gaps and make a solid defence. Good luck!

Thanks for the concerns, actually all my immigration history has been intact except this late one of 31/12/2018 that’s making scared. I don’t really know if paragraph39E will be apply.

[1] should i mention the appeals stage by stage and details by details?

[2] when providing documents should i enclose all the appeals letter with other documents?

Hello guys, please how can someone get back NHS subcharges after all appeal rights end and new application has been submitted. I don’t pay the money through my account it was through my lawyer account. I just want to know when it suppose to be returned it been two weeks now.

Just want to say thank you for the advice, my wife indefinite leave to remain Has been granted and the biometric card has arrived. But I’m still waiting for mine to be approve.
