FLR(M) extension

Hi there, i am wondering if someone can help me. I am due to apply for the second 2.5 years for FLR (M) later on this year. My visa runs out on the 9th of November 2020 and i am due to fly back home to New Zealand for Christmas mid December. I am hoping to apply the standard (8-12 week) route slightly earlier than 28 days before it runs out so i can make sure i receive my passport/BRP before flying back to NZ.

Does anyone know if this will be possible and are they lenient on applying any earlier?

You should apply no sooner than within 28 days before reaching 30 months residence, counted from the date you entered the UK on a spouse visa (not fiance visa of this is relevant)

Thanks for your reply. I was here on a Youth Mobility visa from June 2016, then in 2018 i went on to FLR (M) unmarried spouse visa. Guessing this doesn't count toward the 30 months residence?

Maybe the processing under standard route go beyond to 8-12 weeks due to previous backlog.

You should then apply within 28 days before the first flr m visa valid from date. Time on a Tier 5 YMS visa doesn't count.

Sorry, just to clarify. I can't apply any earlier than 28 days before November 9th (when my FLM (M) visa expires)?

In that case, i will probably have to use the super priority service which is currently unavailable due to the current circumstances. Do you think this service will be back up and running come October time?

You can apply earlier but bear in mind that if you get a quick decision using standard service, you will end up with a shortfall for ilr which might require a 3rd FLR m extension to cover a short period.

Note also that IHS is increasing on 1st October to £624 per year, so £1560 plus visa fee of £1033 for an extension.

Hmm good point about the IHS fee. Do you think i could apply on the 30th September (Super priority) to avoid this? It would be slightly more than 28 days. Thanks

Which 30 months residence?

Note also that paying for super priority service, when it is available again, doesn't guarantee a quick decision.

Your new visa is not tagged onto the expiry of the current visa. It is valid from date of decision usually.

I received my answer on the same day for my first round of FLR which was May 9th 2018. Exactly 2.5 years to current expiry Nov 9th 2020.

So if i applied on the 30th of September 2020 (to avoid IHS increase) using Super Priority and my visa runs out on the 9th of November 2020, would this be OK? Would i still have enough months to make up 5 years for IRL later down the line. Thanks for all your help.

With this approach there might be a shortfall and you might have to spend on third extension assuming you obtain the visa on 30th September via super priority. However, if you apply via standard route and delay your biometric then might be able to kill two birds with one stone (save over ihs & 3rd extension fee) but unfortunately your travelling might be disrupted.

If you do this specifically to avoid the increased IHS fees, you may need to book your biometrics appointment in late October or early November (if there is a backlog, this may happen anyway) to avoid ILR shortfall.

The application will be decided after the biometrics appointment.
