@Emr : its completely fine if you disagree but it is what it is.. about your second point I didn't mentioned null and void wording on any decision, I wrote I was told by solicitor, please don't take sentence out of context.Emr wrote: ↑Tue Jun 29, 2021 6:48 pm@finalversion, regarding the tricky advise from you solicitor, personally I disagree, based on below two points:
1: if you read the full judgement based on which you have applied EP, Judge allowed that guy for EP as judge mentioned that his stamp 4 will be revoked.
2: the temporary stamp 4 based on review will only be revoked at the time when the decision from review is made but this temporary stamp 4 is a valid stamp prior revocation from review. I have never seen null and void wordings on review decisions but is revoked at the time of decision.
But would love to hear other members thoughts on this.
OMG I didn't know this was taking that much!finalversion_2k wrote: ↑Wed Aug 11, 2021 10:45 amKaren applied on 18 Jun.
these days its taking 14 weeks for Normal applications.. and 10 weeks for trusted partner applications. today they are processing applications of 23 April.. to track the EP processing dates.. https://enterprise.gov.ie/en/What-We-Do ... ing-Dates/
well you definitely didn't read this thread completely, thing what your solicitor is waiting for is already on their web. https://enterprise.gov.ie/en/What-We-Do ... mits/Fees/finalversion_2k wrote: ↑Tue Jun 29, 2021 2:55 pm@Emr Sorry for late reply, I decide to submit application first before replying anything.. so now answer to your questions.
Yes EP application is submitted, now have to wait and watch. solicitor is very confident about EP to be approve. but he also Flag that my review application decision will also be important.. lets see..
but he suggest its better we should apply for EP, Reasons: DBEI start following the High Court judgment and accepting/processing EP applications by Stamp4 candidates. Proof is fee section of DBEI web page bottom. where they mentioned about fee for EU spouse.. previously it wasn't there. updated on 22 March after few weeks of court judgment.
@karen711 would you like to share what approach your solicitor suggest after EP.. I was told very honest and tricki thing by my solicitor and that is 'If department still on revoking decision then there will be complications' Reason: because that means when we apply work permit on temp stamps, those stamp were revoked and legally null and void.. you know what I mean. will like to hear what your solicitor told.karen711 wrote: ↑Sun Jun 20, 2021 8:13 pmYes. I have full filled all the other requirement. Job letter salary experience etc. I don't think so getting IRP card would be a problem once it's approved by the department work visa. U just have to apply only IRP card and withdrawal the application from EU fan. Only problem is I had allegation of marriage of convenience on me not sure if that cause any problem. Keep me in your prayer . It was the last errow that I had and it's it's gone.

Oh you are right! I didn't catch this part was relevant for my case! I'm still not very sure if this would apply to me as I got the stamp based on a de facto partnership.
well you didn't mentioned your status and neither your circumstances OR why you want to apply workpermit when you already have stamp4.. Idea of stamp4 to stamp1 came after guy win case in court. background of case was his stamp was going to revoke that's why court order department of Enterprise should accommodate those applications. Now question is why you want to apply?AS2021 wrote: ↑Fri Aug 13, 2021 3:29 pmAS2021 wrote: ↑Fri Aug 13, 2021 3:25 pmfinalversion_2k wrote: ↑Thu Aug 12, 2021 8:35 amwell you definitely didn't read this thread completely, thing what your solicitor is waiting for is already on their web. https://enterprise.gov.ie/en/What-We-Do ... mits/Fees/finalversion_2k wrote: ↑Tue Jun 29, 2021 2:55 pm@Emr Sorry for late reply, I decide to submit application first before replying anything.. so now answer to your questions.

@Ch123, thanks so much for sharing your experience, I am similar situation and need your help.ch123 wrote: ↑Thu Mar 18, 2021 8:54 amYou can write to them. However, I think you have to be fully refused by the Department and then they forward your file to the repatriation dept for deportation. In my case, I was fighting the EU treaty rights refusal in court. Otherwise you have to contact the Department itself because repatriation unit wouldn’t have your file.
Like I said, I had exceptional circumstances. It’s more about how accurately and precisely you explain your circumstances.
@emr any update from MRCI on this?Emr wrote: ↑Mon May 24, 2021 2:12 pmHi All,
A possible suggestion. Could we all reach out to MRCI to confirm what is INIS policy on EP based on temperary stamp 4 from EU treaty. I know MRCI have a direct contact with the department and they will clarify this for us. As I know MRCI told us when the special student scheme was lauched and they contacted INIS and got confirmation those students changed their status will not be qualified for SSS.
So it would be clear if we contact MRCI to get clarification
1st. when you applied for work permit you have to mentioned your current status, what you wrote in that? if you wrote 'Yes have valid stamp 4' But didn't mentioned its revoked that could cause issue when they will reach out EU treaty department.. @littlerr, @finalversion I am in a similar situation and got a few questions if you can help out:
1st- My temp4 was valid until 20th Sept issued by EU Treaty. They refused my review in May 2021 and forward my file to the Repatriation dept for further action, never received anything after. I applied for EP at the end of last month. Now, If I got my EP approved sometime next month, would I be ok to renew it GNIB still since I would not have any valid permission.
2nd - EU Treaty issued me, temp stamp4 and stated " Temp Stamp4 is not an acknowledgment to residence under EU treaty Rights during this time and will be determined in due course when the review will be either approved or refused". So now since the review is refused, would I still hold valid permission? If not Dept of Justice also approved a temp stamp extension to everyone until Jan 2022 so I guess it would be valid without any IRP card.
3rd - Are you aware if we can reach out Repatriation dept by email? If yes, any sample letter to write to the dept to grant me a temp stamp?
Thanks so much in advance guys, hopefully, we will have some good news to share soon and our intense life can take a better turn moving forward.
Sorry I'm little confused, you mentioned your review was refuse in may2021 (would you please tell what that review was for??) Yes I understand when they send temp stamp letter they don't put wording of revoked, all they do is write about temp 4..raj1936 wrote: ↑Wed Sep 29, 2021 11:01 am@finanlversion thanks for your input.
1st - Yes I mentioned I had stamp4 when I applied for EP and I confirmed with couple of lawyers that my temp stamp4 was valid since there was no mention of revoke in the letter just fyi so I believe it was valid when I applied for EP.
2nd - Again my temp2 is not revoked and it was valid, confirmed with few lawyers no issues on this.
3rd. I have already requested Rept dept to provide temp stamp based on my current circumstance but didnt get anything since couple weeks. So I guess it's a normal response and would get something shortly. In meantime do you think I can get temp extension from GNIB? Also, getting appointment is almost impossible, any idea how can I get the appointment from gnib, any email address you are aware that they reply fast?
@littlerr, please give your input on this. Thanks.
