The time is calculated from the date UKBA recieved your application. If there are no additional investigations in your case then it should be decided within 6 months. Nearing to 6 months or after that time, you can write to them threatening legal action if they have not processed your application. However, bear in mind that they are only bound to process the application within 6 months, there is no requirement for them to have it delivered to you within 6 months. After the sticker is printed/affixed to passport, the mail room sends out the post which may take upto 2 weeks and then further upto 5 days for 2nd class mail to reach you.

The average time for EEA2 is about 4 months.

Yours has been under consideration for 5 months, if I am not mistaken, so hopefully you should get a decision soon.

Sometimes the UK BA sends out requests for additional documents. Have you received any ?

I came across a few cases when the requests were sent by the UK BA via the 2nd class mail and were lost. Guess the consequences...

hi guys, HO received my application by 8th of April for eea2, requested my and my partner passports by 20th may and got them by 2nd june. in the covering letter HO wrote that you should get a family permit before entering the country. i dont know if that is normal and usual standard covering letter or not. n i still did not received my RC . while many peoples are getting it back by three months.

thanx for the help.

I believe this is a standard text. As you asked for your passports, they suggest that if you travel outside of the UK and your Family Permit is not valid any more to apply for a new one as the Residence Card has not been issued yet.
Most people get RC in 3-4 months so you are still within the average range. Hopefully you will get it in a few weeks.

Right guys, its been a long emotional road but its nearing the end

I emailed the North West Customer Complaints, which i think i found on here, on 13th July. I had completely forgotten i had done it until i received an email from them today.

They can confirm that instruction to ISSUE RC was made on 19th July 2011 & all our documents are in the Secure Holding Centre waiting to be despatched in the envelope provided.

So it seems McCarthy Judgement did not effect our application :D

Good luck to everyone who are still waiting & i will update once we actually have Passports back in our hands

Wow, this has been totally unexpected.

APPLICATION RECEIVED: 17MAY
COA DATED: 8 JUNE
RESIDENT CARD DATED: 21 JULY
RECEIVED IT: 23 JULY

History: applied under EEA wife being self-sufficient (looking after baby) and i was working. Used health-on-line "personal choice" private medical insurance and costed £78 for the three of us (essential cover, option 2,3,4,5 and £500 excess).

this is just half of a story of a long endurance to get EEA family permit (2 rejections).

Good luck to everyone, pm me for any specifics etc
