Tier 2 ICT Dependent to Tier 2 General

Hi,

I am currently in UK on Tier 2 ICT dependent visa with valid for another 2 years. I'm currently employed with a organization for the last one year and requested them to sponsor Tier 2 General Visa. But I understood from them that Home office will reject the application as I am already a permanent employee with the employer.

My questions are as follows,

1. Is there a timeline that I spend out of this employer, so that they can apply for the sponsorship without getting rejected by Home office?

2, Or, is it that my current employer can never apply for the sponsorship for me?

3. What are the alternative solutions that my employer can provide sponsorship?

Nonsense. Many tier 2 dependents apply for tier 2 General when employed already with a sponsor.

They need to make sure that the full and proper RLMT process has been completed and prove you have not been pre selected for a job that a British, EU citizen or settled person could do.

Thanks. But I am slightly confused. When you say that, the employer will need to do the RLMT and prove that I am not preselected, me being a permanent employee of the organization wouldn't show that I am preselected? Your inputs would be really helpful as I can approach with strong data points.

Hi, your emoloyer need to go thru RLMT process and show that they have selected you as part of the process. They are not required to disclose to homeoffice that you are already working for them for same position. I know it is confusing process but thats how all organizations are handling ICT dependent cases when they request visa sponsorship. For me, entire RLMT process has become a farse witch is followed by employers just to tick homeoffice guidelines.

Hi ,
Thanks for the response.

But am already on the payroll of this employer which means that my NI number would be showing the record from where (organisation) my PAYE TAX is being deducted. This would clearly show that am already part of the employer. Wouldn't Home office verify this and lead to rejection of my visa ?

My employer told me that it will get reject because of the above reason.

Hence can you confirm on this?

Many pbs dependents have successfully applied for tier 2 General while an employee of a company.

The whole purpose of Rlmt is to prove to HO that no British or EU citizen or settled person is suitable for the job. The Rlmt also cannot be done in a way to favour you and exclude all others.

Lordshiva, My wife was in similar situation and there was no issue in her moving to Tier 2 General. Can you share your contact number so that i can call and explain you in detail.

Lordshiva, please talk to your employer again. Not sure why they are giving you false information. There are so many cases like you which are granted visa every day.

@CR001, i think people should be allowed to exchange contact details in this forum for urgent cases. All the risk will be with person who is sharing details. Please help.

No. As when it was allowed it wad massively abused and every response to a topic was an email address. Topics became useless, never mind the many scammers and spammera we have.

Not what exactly is urgent in this users case??

@CR001, It is really very important as I have already discussed with my employer and was denied stating that my COS will be rejected (as a pre-selected candidate).

But as @ramgoel123 has already gone through the same case, his inputs will be vital for me to go back to the employer and getting the COS.

There is nothing "exceptional" in your case. You have been wrongly advised. Many have done what you plan to do and been approved.

Perhaps your employer simply doesn't wish to sponsor your visa or have HO scrutinised them unnecessarily.

It is really straight forward, as has been mentioned by the moderator as well as a couple of other members in the previous replies.
Your employer needs to apply for an RCOS for you and since it is an RCOS, your employer needs to follow the complete process that is laid out for a new hire under Tier 2. I have done the same a couple of months back.
Steps:
1. Your employer needs to publish an advert for the job(check which websites are recognised by the HO).
2. Once the advert has been live for 28 days, the employer can apply for the RCOS(before 5th of every month).
3. Once you have received the RCOS, you need all the documents that a new hire under Tier 2 would need, including a new offer letter/letter of employment from your employer.

It doesn't matter if you are already working in that role, you have to show that a fair opportunity was given for UK residents to apply for the role and that is what the job advert does. Hope this helps.

It is identifying a person, exposing them to everyone and all the scammers and spammers we have on the forum on a daily basis. Then there is also the issue of the new GDPR. The OPs circumstances are NOT 'unusual' or 'exceptional', I failed to understand why you or the OP think this is the case when many PBS dependents have successfully applied for Tier 2 General visas. I also don't understand why you are not able to post your advice on the public page, which would make a someone think that your 'advice' is not necessarily 'above board' and can only therefore be share 'privately'.

If you are not happy with something, post in the 'Comments about the Board' sub forum further down the main page. Not sure what you expect, as all the moderators will reiterate the rules and what I have advised.

Perhaps also familiarise yourself with the forum rules please.

I dont think you are fully aware about GDPR rules and regulations. If both parties are in agreement to share data then no one can stop them. Regarding your constant push to share details in this forum, its difficult to explain few things in writing and much easier to talk. I am sure you being expereinced person, should have realised the same in past. I dont think this board/forum is doing any justice to Lordshiva by preventing me to help him. Yes, i asked him his email id in past post but now i am just asking his name that too if he agrees. I cant imagine why as a moderator you have issue? Is there any super moderator to escalate?
