The 200K is an investment requirement (money into the business). Purchasing premises is an outgoing from the business (money out of the business), so has nothing to do with immigration rules (as long as it is only used by the business).

Ineligibility for ILR will not lead to an automatic extension. It will be a refusal if you do not qualify.

That's not an issue. Obviously, she will not count towards your job creation requirement.

property as part of your business investment

Post by Wesam » Tue Nov 09, 2021 6:57 pm

(i) If you have bought property as part of your business investment, the value of any residential
accommodation cannot be included. You must provide an estimate of the value of the residential
accommodation if it is part of the premises also used for your business. The valuation must be from
a surveyor who is a member of the Royal Institution of Chartered Surveyors dated within the 3
months before the date of application.

------------------------
Could you please assist me with this enquiry

If i bought a pure business office with (no any residential accommodation included in the property) , so i still need to provide evaluation to be encluded as part of my 200k investemenyt? ,
is there anything elso i need to consider in order to ensure the money invested in the business office is part of my 200k, Thanks

It is quite clear - you only need to provide a valuation if there is a residential component

Employees

Post by Wesam » Thu Jan 06, 2022 7:23 pm

For employees I was checking their settlement status by using the link in Gov.uk about check right to work in UK not Check someone's immigration status
Is this ok? , and if not what I can do now as I have some employees left from long time and I cannot reach them anymore.

You will apply for an extension within 14 days of the refusal or AR refusal.

Great

I have one employee, he is British born in England but have no passport , however have a birth certificate show that he born in 1987 (after1983) in England with mother name and he has a UK driving licence, and he have no other documents to provide. as per the guidline they ask for mother passport or birth certificate which he dont have. is their any advice in this situation, by the way this will be very critical to my fast track submission as i have no enough time to hire another employee for 12 months.

Unfortunately, those are mandatory requirements.
I assume you did conduct the Right to Work check as per the requirements at https://www.gov.uk/government/publicati ... le-version.
If so, you can try and submit those requirements and ask for them to be considered - there is no requirement that HO has to accept them, but it is worth a try.

Yes, i did the manual right to work check for him based on point No 8

8) A birth or adoption certificate issued in the UK, together with an official document giving the person’s permanent National Insurance number and their name issued by a government agency or a previous employer.

So i will try with this, hopefully it will work.

Also if another employee, i have his right to work says "There is no limit on how long they can stay in the UK" is this can be considered, as i dont have his ILR document for him

For ILR application submission, it should be 28 days from the end of granted live,

This 28 days for application submission or Biometric date?

for example if the BRP ending 30th of July,2022

Can i do the application submission for ILR in May and the Biometric and document submission on or after 2nd of July?

You can apply for your ILR anytime before the current grant expires. So, in this example, you can apply on the 30th of July, if you want to.

The 28 days referred to is 28 days before you "qualify" for ILR, i.e. complete your 5 year stay. It is the earliest date you can apply to still have the 5 year period counted and has nothing to do with your granted leave.

1- the Setlment application will include only myself as a main applicant and the family will apply for extension only in another application , right?
2- Can i apply for ILR and my family apply later for extension after one month for example as they need to travel that time or better to apply all together?

1 - yes
2 - as long as you apply before their visa expires, it is fine
