Can I get a student visa?

Post by ineedadviceplease » Sun Jun 14, 2015 2:26 pm

I am a US citizen who has recently been refused entry to the UK. They turned me away and put a big rejected stamp with an X in my passport.

I am now planing on obtaining a Tier 4 Student Visa (General) for this year's intake at Universities in the UK. On paper I am eligible. I have the fees ready to pay for the visa. I have an offer for a postgraduate degree from a good University. I have only spent 12 months in the UK as a student previously, for a different postgraduate course. The course I am now being offered is an extension of my earlier course, so I can demonstrate educational progression. The course is also full time.

Will the entry refusal adversely affect my Student Visa application? Should I try and get a new passport before applying for my visa? I know they have records so getting rid of my passport won't matter to the application, but it might be better not to have the big X in my passport? Any constructive and useful advice is appreciated.

What was the reason for refusing you entry?

Getting a new passport to avoid the rejected stamp won't make any difference and could be viewed unfavourably by UKVI. HO will know about your refusal of entry when you apply for a student visa, however, depending on why you were refused entry and if you meet all the requirements of a Tier 4 visa, it might not have an impact.

I don't want to get into specifics, but it was basically because they said they did not believe I would leave the UK because of my social situation (partner is a UK citizen). I was not in any trouble, and had done nothing wrong. I AM eligible for the Student Visa, on paper.

So you think I should keep the passport? And you think I should be able to get the Student Visa despite being turned away before? Becoming a student has changed my social situation, as I will be attending classes and getting a degree, so will that be enough to convince them to let me in?

I have a student loan showing enough fees to pay for the course, and for my living costs for the year.
