Madgrrl wrote:Hi,
I was just wanting some advice about our options. I'm a British citizen, my boyfriend has joint NZ/US citizenship and currently resides in Australia. We've been together a year, known each other about 1.5 years and he's currently staying with me on a visitor visa (3 weeks so far). This is his second visit here in a year, last time he stayed 2 months. I know that it's 6 months max in the UK as a visitor and I don't want anything untoward happening with UK immigration so where do we go from here? He cannot apply or switch into any other visa category from within the UK. He would have to leave and apply from his country of residence.
I think it would be easier, in practical terms, for him to move here. He can work from home so wouldn't need to look for a new job, at least not right away. He doesn't have a home to sell but I would. However, I do not make £18600 a year. I might do in the future possibly but no guarantees. If we get engaged or married would that make things easier? He's also looking into his heritage as he thinks he might have had a British grandparent or great grandparent so maybe ancestry would be an option? There is no way to get around the minimum income requirement that YOU have to earn for him to qualify for either a fiance or spouse visa. If he has a British born grandparent, he can come on an Ancestry Visa. He can't come on an Ancestry visa if it is a Great Grandparent though. Ancestry is cheaper and easier to obtain so would be a good option if he qualifies.
Other long term possibilities would be me joining him in Australia, or us both going to the US, not sure how that would work though. He's not a fan of NZ (weird I know!) so don't think he's keen on moving back there. I was reading somewhere that partners of Kiwis can only join them in Aus if they've been living there x number of years, which he hasn't. You would need to ask these questions in the Australia/US forums further down on the main page of the forum.
It's still early days yet but it would be good to know what we can do.
Many thanks for any advice.

Even if you marry you will need to meet the income requirement to bring hubby to UK under UK immigration rules.Madgrrl wrote:Hi,

Madgrrl wrote:Hi,
Just wondering, does the above amount have to come from me alone (as a British citizen), or could my partner contribute as well (assuming he was sponsored by work to be here, or similar?)
Thanks,

For T2 ICT sponsorship the local test will need to have been performed to prove no local candidate was suitable, and the company needs to be a licensed sponsor. Also if he is a remote worker I very much doubt he'd be successfully as there seems to be no actual need for the work he does to be performed in UK.Madgrrl wrote:Thank you, I was wondering if perhaps his company could sponsor him to come here? They have an office in England and he works remotely anyway so it could perhaps be a possibility.
I imagine savings would have to be per year so it's £18,600 for each year he's here?
