Visa for my wife and child

Greetings,

I am trying to apply a for a visa for my wife and our 2 months old child to come and join me in the UK and stay with me without limitation such as having to leave the country at 6 months etc..

I am British Citizen and my wife and child are from non-EEA country. After doing some research I concluded that the visa type we are looking for is Family of a Settled person visa. I am in full time employment and meet all conditions to be their sponsor.

What is confusing for me is when I attempt to start online application, I am not sure which option refers to "Family of a settled person".

If their intentions are to settle with you, then they cannot choose visit in the first category.

Is your child British? Note that a British child cannot apply for leave.

We are planning to eventually settle, but when I go through the wizard option on UK immigration site, it says that "Family of a settled person" is the type of visa.

No, neither my son or wife are British. I am not even sure what "apply for leave" means. I am not currently in UK and cannot find relevant immigration solicitor.

I am not sure if "Family of a settled person" refers to settlement. I am also aware of settlement visa, but I am not sure if we qualify.

You need to have been living in the UK with a ‘partner of a settled person’ visa for:

2 years if you applied for your visa before 9 July 2012
5 years or 10 years if you applied for your visa on or after 9 July 2012

For settlement visa you have to live in UK for at least 5 years prior to applying? So our choice has to be "Family of a settled person"?

Are you clicking on Vinny's blue links? You say that you are not currently in the UK. Are you usually resident here? If so, do you have income of at least £22,400 per annum or have over £62,000 in savings held for 6 months in an accessible account?

Since April this year, I have been earning just over 23k, which according to guidelines is fine in turns of figures and length (over 6 months).


What confuses me now is I have made two separate applications online, one for wife and another for child. The application for child has questions which cannot possibly be answered accordingly since he is 2 months old. Also, in each of their applications there is a question "is someone traveling with you", so I have included each others name on both application. i.e. wife traveling with son, and son traveling with wife. On top of that, for each you have to choose whether other has visa.

And finally, do I have to make two separate appointments at embassy for them. I am currently checking this site;

Greetings again,

I am applying for settlement visa for my child and wife.

We are required to prove that are our relationship is genuine.

Thus, I am planing to submit copies (photograph page, and stamp pages), of my OLD UK passport as evidence that I have traveled to a country of my wife.

The question is, does this passport need to be attested, even thou it is previous passport and it is only used (including pages with stamps from it) as proof of relationship.

Also, my parents who are providing accommodation for us in UK, have accommodation report and support letter. Do I, as sponsor, have to submit their passport copies, and do they also need to be attested.

Can i confirm, that when you return home with your family, you will have similar job with earning up to 22,400.

...and that you have written confirmation from the employer that the job will start within 3 months of your arrival in the UK.

Thank you Obie & Casa. Thankfully my earning and employment are not an issue.

I have technical questions which I cannot find answers for. Last thing I need is to get refusal on technicalities. Please see my unanswered questions above.

One of the questions is:
How long do you plan to stay in UK?

We plan to settle, eventually permanently if possible . I am not really sure what to answer for this question.

Another one is (for a child):

Who are you travelling to the UK with?

-> Mother

Are you staying at a private address in the UK?

-> Yes

then

Who are you staying with in the UK?

closest available options are "Grandfather" and "Grandmother", but no selection "Father" and "Mother"

Entry clearance granted, BRP to be collected.

No calls to employer, no calls to parents (house owners), no calls to me (sponsor), no calls to wife, no interview.

Straight forward.
