Under 18 or not?

Post by trevoronitselec » Fri Jan 15, 2016 10:10 pm

I will invite my stepdaughter this year to visit me, her mother and sisters here in the UK. During the time of her VISA application she is under 18 years old but will travel 2 days after her 18th birthday. Do we still to provide requirements for under 18 years old?

Whatever is applicable at the time of application.

What will she provide as proof of her ties to home country and her intention to leave the UK after her visit and to convince the ECO that she is a 'genuine visitor'?

Just to confirm, so it means she's still under 18 and will require the under 18 documents?

She will only visit us during her semestral break and will return to continue her studies in her home country. Do you know what document from the school can we use if this is enough reasons for her to return?

If under 18 at the time of application, then that is what is required.

A letter from the school stating her studies, terms break length and continuation of studies when she returns on X date.

Where does she live in her home country? Letter from her legal guardian might be good too.

She lives with her grand mother's sister (father side). Her biological father lives in another country and literally not looking after her. To whom it is ideal to get the letter? Is it from his father or from her grand mother's sister will do? What will prove her the legal guardian? Proof of address from the child and the guardian?

Who is legally responsible for the young lady in the place/country that she lives?
Is there an official & designated legal guardian?
Suggest that person should provide such a letter.

she was living with her uncle and grand mother's sister.. but I think no official document to prove they are legal guardian designated by the court. Will the HO look for evidence? Is a birth certificate of his uncle plus a letter of consent from his uncle sufficient?

My understanding is you will need letter from parent or guardian.

You can't concoct such documents so if those family members fulfill such a role then suggest submit a letter from them.

OK I will ask them to provide a letter signed by notary, in addition My wife who is her mother living with me here in the UK will provide a consent letter too.

Now my next question, do we also need a letter from the father which is living in another country?

OK I do understand that under 18 requirements will apply on child "Are under 18 years at the time of your application";

but when we try to fill up the online application, we cant choose the child visa option and only family visa is available since the child will turn 18 2days before the notified date of departure. Is the child VISA application form different from the family VISA form?

Is it OK to still send the additional requirements for under 18 but with the family visa application and explain it in the cover note?

Can anybody help? I am really confused now.. when we are doing the online application the system wont allow us to create a child visa application it says "the VISA is for person under 18 only, you cannot apply for this visa.

It seems the system's reference is the intended date of travel... since my stepdaughter will fly 2 days after her 18th birthday.

The systems says "the VISA is for person under 18 only, you cannot apply for this visa". And from the application form created there is no under 18 category.

Is it OK to still send the additional requirements for under 18 since she will send her application whilst shes 17 and explain it in the cover note or this is no longer needed to avoid confusion?
