Visa for new born baby - now or together with my visa on ext

Post by matwalaboy » Tue Feb 02, 2016 7:56 pm

Hello all,

My current Tier-2 general is valid till December 2016 - and I would be renewing it again in the 3rd week of November through my company.

We are also due our 2nd baby in March 2016 and don't foresee any travels for the rest of the year.

So my question is do I need to still apply for a visa for our baby (once she is born) or can I just apply together with my visa later in the year? Will the UKBA raise objections to the fact that why I didn't apply for her visa earlier if I don't get the visa done when the baby is born?

I have read a number of other threads (not conclusive - hence the query here) where people seem to suggest that as long as I am not travelling outside the UK I don't need to apply for a visa for the baby born in the UK on their birth itself and can do it later on.

There is also http://www.immigrationboards.com/immigr ... ml#p178960 which is old now and I am not sure if the laws in this regards have changed since then?

Please don't misconstrue my question as I ofcourse intend to play by the books, but just want to make sure I don't end up spending for her visa for the next 7-8 months, when I can possibly save up and do it later in the year.

Your help appreciated, as always

Regards

Not sure when you would qualify for ILR but your UK born child would not need a visa at all if you have absolutely no plans to travel and baby can register as British as soon as your ILR is granted.

Thanks for your reply - I am currently in my 3rd year of the Tier-2 General, so still a couple years and more left for the ILR - but even on my Tier-2 general then I don't need to apply for the child's visa straight away and can do it along with my extension, with no hassles at all then from UKBA, right?

Thank you so much.

How does the immigration checks work - say for instance we wanted to travel to Scotland with the baby, Scotland is part of UK so we haven't left the country as such and hence shouldn't need a visa - or I am asking for trouble risking it?

You can travel freely to Scotland, they use the same visas that you have as they are part of the UK.

Thanks - however as said earlier I am not planning on applying for the visa of my baby (to be born) and will do so when ours come up for renewal towards the end of the year - so that shouldn't be an issue right? All the others in the family of-course have valid Tier 2 visas.

There are no border control between Scotland and England. You are overthinking things.
