Switching from Tier2 ICT Dependant to PBS Dependant

Post by sivag » Fri Feb 26, 2016 7:47 am

Hi All,

I'm currently on Tier-2 ICT dependant visa, I need to switch my visa status into PBS dependant for 3 years extension in couple of months time, could you pls provide the exact UKBA link to apply PBS dependant?

I am not sure PBS dependant means whether its Tier 2 ICT PBS dependant OR any other general PBS dependant what will be my visa status?

As my husband recently granted with ILR, I understand switching into my status as ILR dependent will reset my 5 years stay clock so best option would be PBS dependant...

I really appreciate and thankful for your suggestions on this...

Thanks,
Siva

On what basis was your husband granted ILR?

Thanks for your reply Vinny,

My husband was on Tier 2 ICT before getting his ILR. I got my first Tier 2 ICT dependent visa by July 2014.
Based on this now I've two options to switch into family member of settled person maximum 2.6 years visa duration OR PBS dependant maximum of 3 years I beleive. However I am not sure whether PBS dependant means my stay will be extended as Tier 2 ICT dependant OR any other general PBS dependant.

Could you pls provide right UKBA application link to extend my visa as I am in UK my current Tier 2 ICT visa will be expired by April 2016.

Hi Vinny,

In more detail, my husband was on Tier 2 ICT he has completed his 5 years stay then granted with ILR, my first Tier 2 ICT defendant was granted on May 2010, however I stayed more than 180 days outside UK and my clock has been reset by applying new Tier 2 ICT dependent visa from outside UK by July 2014.

Thanks,
Siva.

You may continue to extend as a Tier 2 (ICT) dependant until you qualify for SET(O).

You may be exempted from paying the Immigration health surcharge under 1(i).

Great, thanks for clarifying this Vinny, I appreciate if you can clear one more that my current Tier 2 ICT expire expires by April 2016 if I can extend it for another 3 years as its maximum duration that will be valid till April 2019.

However I am eligible to apply ILR by July 2019 as it complete 5 years by that time, what I need to do once current extension expires by April 2019? Am I allowed to extend another 3 years until I get an ILR OR Is there any possibility to get extension now till July 2019. Thanks lot!

They may grant leave for a period of three years, from the date of the decision. Suggest you apply by recorded post shortly before your leave expires. Who knows how long they may take?

My apologies Vinny, I'm unable to find UKBA link to submit Tier 2 ICT dependent extension application detail. Do I need to submit this online or any form that I need to download and submit it by post? Sorry to trouble you on this. I appreciate if you can clarify fund maintenance requirement while applying from inside UK. Thanks.

Tier 2 Dependents is an online form only. There is no longer a paper form. See link below to apply.

Dear Moderators - Vinny and CR001,

Many thanks for your great help. I am able to submit my PBS dependent extension application with your kind support and left few queries. I'm really thankful as you have saved my money and peace of mind. Still I need your help to clarify below queries. thanks again.
----------------------------------------------------------------------------------
Proving you have enough money to be in the UK
You must provide documents showing you have had at least £630.00 in cash savings for 90 consecutive days.

Question-1:
- I do not have enough balance of £630 in my account for 90 consecutive days. Will it be accepted if I submit husband bank statement to meet this requirement?
---------------------------------------------------------------------------------
Your biometric residence permit (BRP)
Do you have a biometric residence permit? (Required)
This is a card with your name, nationality and picture. It describes your entitlement to be in the UK.
Question-2
- I do not have BRP card, instead my UK visa was stamped on my passport. Will it be OK to submit my Visa unique number printed on top right corner?
----------------------------------------------------------------------------------
Question-3:
- May I know how many days in advance I'm allowed to submit my application before my current visa expires?
----------------------------------------------------------------------------------
Which visa or permission to stay has main applicant applied for or been granted:

Question-4:
Tier 2 ICT Long term staff leave to remain. - This was my husband stated before ILR granted. Is this right answer?
---------------------------------------------------------------------------------------------
Do you have one of these home office reference number:

Question-5:
Main applicant ILR BRP unique number. Is that correct answer?
-------------------------------------------------------------------------------------------------
Does main applicant have indefinite leave to remain or british citizenship? Yes
What is the length of Mr main applicant Cos?

Question 6:
As he has gratnted with ILR not sure, what to choose 3 years or less or 3 years or more. Hint says it can be found in main applicant cos certificate. However, he switched from his employer no link with his sponsor not sure what to choose on this now.
---------------------------------------------------------------------------------------------------
Has Main applicant's sponsor agreed to certify your maintenance? Main applicant has no link with his sponsor now
so my answer will no 'No' for this. Pls suggest.
----------------------------------------------------------------------------------------------------

1. Yes.
2. If you don't have a BRP, then I think any questions relating to it would not be applicable.
3. You should apply before your leave expires.
4. Probably. Not sure.
5. Probably. Not sure.
6. Three years.
