Child Visa

Post by cerahurley » Thu Jul 28, 2016 7:27 pm

I'm sorry if this has been asked before, but I have been looking through the threads and haven't really seen anything like my situation. I also did not see a search option to look for something similar.

I am a dual citizen US/UK. I am UK citizen by descent. I am looking to move to the UK with my under 18yo child who is US citizen only. I have sole custody of my child. I have been reading about the visas and immigration for almost a year, have called the pay line, emailed, and always have gotten conflicting information. Do I need to meet the income threshold to bring my child over, even though I am not bringing a spouse, she is under 18, and I am her sole caregiver? If so, are benefits calculated into income, or are they excluded from income? I have read that she would be eligible for ILE since she is a child, does anyone know if that is correct? And if so, would I just have to show adequate maintenance or do I need to have a job offer in the UK before applying for her visa? I meet the income requirements easily with my current job in the US, but don't know how much luck I am going to have applying for jobs in the UK, while I am residing in the US. I am trying to keep from having to move to the UK without my daughter first. Thanks for any and all help!

Benefits are not included in income, it is salary only.

Yes, she will likely be granted ILE.

When last did you live in the UK, if ever?

Thanks for the reply. I have never lived in the UK, this will be the first time. Do you know if I have to meet the income requirement or just have adequate maintenance? I can't find any clear information on it. Thanks.
