Hi Friends,
I am on Tier 2 ICT long term(came on June 2016) and my wife is on PBS dependant visa working.
Now (June 2017) she got a new job where they have offered to raise TIER 2 General visa.
Query 1:- Is she eligible to file for ILR ? If yes how many years in total needs to be completed on this Tier2 General?
Query 2:- If your answer is yes to the above query then as I am on ICT long term will my current tenure count for ILR too? Or is it I need to change to Tier 2 General and then complete certain years ?
Query 3:- Lastly if my wife gets ILR and I am still on ICT can I SWITCH to ILR directly once her ILR is processed ? Or do we have any other way yo be followed?

Query 1:- 5 years on tier 2 general as the rules stand now and she must meet ALL the requirements for ILR.
Query 2:- for you to qualify, you can apply as a tier 2 dependent and will need 5 years in dependent category to qualify for ILR and meet the requirements. Tier 2 ICT does not count or lead to ILR.
Query 3:- no you cannot. See my answer at #2.

Thanks a lot for clarifying my queries.
I just over heard that Tier 2 General Route is also closed so was bit confused.
One last clarification:- once my wife gets the IRL processed and me being on ICT long term what are the available options for me to switch to ILR ?
Should I opt for Dependent Tier 2 General visa and complete 5 yrs or is it being dependent can I get the ILR less than 5yrs ?

Really, where did your hear tier 2 general is closed for ILR?
You cannot apply or "switch" to ILR based on your spouse if you don't have a PBS dependent visa and choose to stay on ICT visa.
You must have 5 years residence as PBS dependent to qualify for OLE, there is no short route or short cut. If your aim is to get ILR, you should switch to PBS dependent as soon as you can to start the clock running.

Perfer thanks again
Have got couple of friends who can before 2011 April and now got citizenship too. Heard from one of them that all routes for tier 2 are now closed towards the PR.

Don't believe everything your hear. The only routes that cannot get ILR is Tier 2 ICT and Tier 1 General (after April 2018),
Tier 2 General is still a route to ILR at this stage.

1. What is the difference between "Tier 2(General- New hires- restricted) visa" and "Tier 2(General) Visa"?
2. "Tier 2(General- New hires- restricted) visa" are you still eligible for PR in UK after 5 years?

1. Same thing. Restricted CoS visa is for applications outside the UK. Unrestricted CoS is for employer switching within the UK.
2. All Tier 2 General leads to ILR after 5 years provided you meet the ILR requirements.

Hello all,
My wife is currently on "Tier 2 ICT Long term dependant visa" working for a local company here in UK .
Can she switch from "Tier 2 ICT Long term Dependant Visa" category to "Tier 2(General- New hires- restricted) visa" category in case her company is ready to Sponsor her VISA ?
Does she need to serve any cooling off period ?
Kind regards,
SHK

She has to apply outside the UK from home country for a new entry clearance visa. She cannot 'switch' to it, which is an application within the UK.
Does she need to serve any cooling off period ?
No.

Hi All,
My wife is applying for Tier 2 General from home country( Outside UK) and submitted the VISA application yesterday(14th June).
Based on the new rules i know that per year 200£ is the IHS surcharge which we need to pay to UK govt.
As she is applying for 5 years she need to pay 200£ X 5 =1000 £ is what my understanding is.
As she completed her VISA application and about to pay the VISA application fess last step was pay IHS.
She clicked the link and entered all the details asked such as name, DoB.. there was a section which says is your spouse living in UK then provide his/her IHS reference number.
Myself living in UK currently so she gave my IHS number and then continued and surprised to see the IHS amount quoted as "0.00" and generated the IHS number for her. further clicked continue she was routed to VISA fees payment gateway and application slot booked.
Question 1: Why did IHS show Zero?
Question 2: Do we need to ignore and appear for VISA slot( biometric)
Question 3: Do we still need to pay IHS fees if yes how will we know the exact amount and where to pay?
Please guide me on the above if any one of you have faced similar issue.
