7 year Children Rule

Post by Jamit999 » Wed Feb 07, 2018 9:17 pm

Hi,
I came to UK in April 2011 on Tier 2 ITC visa and my family joined in Sept 2011.
My daughter who will be 10 years soon will complete 7 year in UK in Sept 2018.

I want to know more details about ILR via Child Route (7 year), i heard that rejection ratio is too high.
I have about 6-7 month in hand, please help me to understand what the rule is and what care is required while applying, guide or experience of anyone who has applied and get success will be really helpful.

Thanks & Regards
Amit

Google is your friend, as is the search bar at the top right hand corner of this site.

Freemovement - Can children and parents apply to remain after seven years residence?

Lowmostly - The 7 year rule: immigration law resources for families with children

EIN - When is it reasonable to remove a settled child from the UK?

immigration-for-family-members/7-years- ... l#p1273813

Essentially, the rule requires not only 7 years residence in the UK for the child, but also proof of why it would be unreasonable for the child to leave the UK. UKV&I takes the view that children are generally quite adaptable and leaving the UK is not unreasonable for them normally.

Calculation of 7 years continuous residence by a child

Post by lp005 » Sun Jul 22, 2018 11:32 pm

Dear Members,
I have few question on the 7 year route. I gather that many of you'll have been waiting for a decision from HO on the the child settlement route.

1. I will be applying for my sons 7 year route in Sep1'9 and and my Student visa expires in Oct'18, can i continue to stay in the UK while my decision is still being made ?
2. What Visa will i be staying on after Oct'18?
3. if the HO takes 1 year to revert back on my application then will that 1 year can be included to my 10 year long residence route?

Appreciate if someone can throw some light on this questions !

Thanks in advance

September 2018 or 2019? Your earlier post suggests the former, your current post the later.

Is your workplace not applying for a Tier 2 visa for you?

How old is the child and why is it unreasonable for the child to leave the UK?

Dear Simon,
Thanks for replying on my thread.

Apologies on the typo, I meant Sep'18.

My partner is on a Tier 4 student visa which is valid until the end of Oct'18. I am currently working on a Tier 4 dependent visa and my employer doesn't have Tier 2 sponsor license. But they are quite keen in giving me a permanent role.

We came here to the UK in Oct 2011 and my entry clearance was granted in Aug 2011.

My son has been attending school and has been part of the UK system his entire life. He can associate more to this place than his country where he was born, which is understood as he came here when he was only 6 months old. He doesnt speak neither of the parents language and only communicates in English. Taking him back now would be like fish out of water. He feels that every time we go back to see his grans on holidays. After a long deliberation, we have decided to apply for his 7 year route.

Appreciate any guidance and support in my application.

Thanks !
