Dependant visa status - Tier 2 Job change before/after receiving curtailment letter

Post by kazpar » Sun Nov 18, 2018 8:27 am

Hello Everyone,

I recently switched to a Tier 2 visa from a Tier 4 visa. I also have one dependant (my wife) linked to the visa.

Unfortunately, the sponsoring company is shutting down owing to financial troubles. As a consequence, I had to look for another job. Luckily, I was able to do that. However, the new company is in the process of getting a Tier 2 license (already applied) and it might take a month (or more) before it is able to issue a CoS.

The employment at my current company ends in another month, after which they will have to notify UKVI. As a result, I might receive a curtailment letter for both my wife and me before I apply for a Tier 2 visa again.

According to other forum posts, I usually don't need to reapply for the PBS dependant visa if I am changing employers and applying for a new Tier 2 visa. Does that hold even I receive a curtailment letter for both of us?

Has someone been in a similar situation? Any help would be highly appreciated.

If BOTH of your visas are curtailed, then you will have to apply for your dependent too.

Thank you for your reply.

Is it a norm for a curtailment letter to be sent even if I manage to get another Tier 2 CoS or (better still) am able to apply for a new Tier 2 visa before UKVI is notified?

Also, in such a case, are curtailment letters sent out for the main applicant only or dependants as well irrespective of any other factors?
