UK Spouse visa payslip issue

Post by danielhw » Tue Dec 25, 2018 8:12 am

Hi Everyone,

I am looking to apply for a visa for my wife and will be the sponsor. My company, however, is a limited company and I am the sole director. I've shown enough earnings over £18600 as £24160 of which being £8160 directors salary and £16000 being dividends.
The main issue is I have a dividend voucher for £16000 but this was not paid in a lump sum and was done over the year and then tallied up at the end as my work is pure profit invoicing a client as I'm a freelancer. I also, through my company withdraw for credit card payments etc on a when needed basis so my pay/salary isn't the same day & amount so I don't have any payslips to show £680 per month for in my accounts.

Would this be an issue with the ECO as I don't have payslips for myself but I can provide accounts which have also been given an accounts certificate of confirmation from an accountant who is a member of a UK recognized the body as well as a P60 for my own earnings?

Should I have payslips done for £680/month and split dividend vouchers, then explain the situation of why pay dates do not match amount and day to the ECO with accountants confirmation or not bother with applying?

I had everything together until I noticed the payslip requirement so any help would be appreciated! I have everything but payslips/dividends matching statements due to the nature of how the business funds me.

Job offer

Post by danielhw » Fri Dec 28, 2018 11:54 am

Hi Everyone,

My wife was in the country a few months ago and worked for a company when she was on a youth mobility visa. They have offered her a job if we get through the spouse visa as they cannot sponsor. Does this job offer hold any weight in the application?

Right now i'm going under category F as sole director but the way my accounts are done which are fine with HMRC might not work with UKBA as payslips and dividend vouchers won't correlate to the bank statement as I draw money when I need and then do a self-assessment end of year. I don't know how much discretion they offer if I supply documents but offer explanations to why amounts does correlate? I can offer a p60, ct600 etc all up to date.

No it does not. For applications made outside the UK, it is ONLY your income and employment circumstances that counts.

Why did she not apply to change to a spouse visa within the UK before her Tier 5 visa expired?

We didn't meet the requirement of living together for 2 years and had gotten married a month after expired, unfortunately.

That is a pity as if you had been married she could have used her income or combined income with yours to switch within the UK.

yeah it would have been a lot easier :D

Right now i'm looking at how to sort this payslip issue, it's really the only thing stopping us applying as i've read they instantly fail if you don't provide any but if i did supply them they wouldn't correlate due to the nature of how i withdraw money and debtors from a client which caused cashflow issues.
