Getting married to american passport holder, moving her to UK. Not sure to do

Post by ukbusinessworker » Sun Jan 13, 2019 10:00 am

Hey everyone, need some help which I am not getting clear information on.

I am a UK citizen. My fiance, soon to be wife in next weeks is American passport holder, currently resides in India.
We are getting married and we want to live together here in London, UK.

From my understanding this is the process and what I need, please someone advise if I'm correct or if something is missing somewhere:

1. Once we are married, and I have the legal marriage certificate, I go online to the GOV UK website to make the application for her. Me, as the UK citizen that is sponsoring her to come t the UK on a Spouse/Family VISA. In this moment of the application, I will also have to pay the online fee's.
What exact questions or things do I have to have prepared ready for this section?

2. After I have done the online application, and paid, apparently I have been told then I get a screen where I have to book for my wife there in India an appointment for the local VFS office there, and then she will have to go and do some fingerprint scan but does she take any documents? Or do I have to provide her with anything?

3. Then once 1 and 2 are done, apparently then I have to send in a dossier document to an address in UK (Sheffield) that will contain a statement from me, my past 6 months of wageslips. 6 months of bank statements, company letter, marriage certificate...and anything else? What is the actual checklist of things I have to provide?

-

I would really appreciate some advice here as I'm getting conflicting advice here.

Also as a note at the end, my initial idea was that she comes back to the UK after we are married on a normal tourist visa as she is an american citizen and can stay in the UK for 6 months and then we get married here in the UK and do the application from here but then a solicitor told me that it's safer and better that if your already married there in India to just declare from the beginning that your married and you want her residency rather then her coming as a tourist then doing it here.

Please advise guys

Is 28 days including weekends?

Post by ukbusinessworker » Sun Jan 13, 2019 10:39 am

When people say

IT IA VERY IMPORTANT TO NOTE THAT THE LAST WAGE SLIP/BANK STATEMENT/EMPLOYMENT LETTER/HOUSING INSPECTION REPORT ARE NO OLDER THAN 28 DAYS AT TIME OF ONLINE APPLICATION

Is this 28 working days, or just 28 days in general?

Oh jeepers! You do need some help!! The FIRST step is not to apply, but to research how you will meet the three requirements of the spouse visa:
accommodation
financial
relationship

She CANNOT apply for a spouse visa from within the UK (FLR(M)) while on a tourist visa. She also cannot marry in the UK on a tourist visa without special permission from the HO. If you are already married in another country and that marriage is legally recognised by the UK (most marriages are except purely religious marriages or bigamous marriages), then you cannot legally marry again in the UK. So that idea won't work...

She also might not be allowed into the UK if she rocks up to live here for 6 months on a tourist visa (living here is not really being a tourist - is it??).

Places for you to do research about how you can meet the requirements:
https://assets.publishing.service.gov.u ... _Final.pdf

https://assets.publishing.service.gov.u ... 1.0ext.pdf

And don't forget about Appendix 2!!! This can be printed and filled in in advance, which may be helpful for you to figure out how you can find evidence for the various aspects of the requirements. The evidence that you provide should not be dated more than 28 days from the application (where letters from employers/ landlords are provided, bills, etc...)

Oh wow thanks alot for this information. I'm getting conflicting information but actually someone just told me last night the same like you, that don't come on Tourist Visa for her and do the application when your back in UK.

So basically I'm going to marry her, our date is Jan 24th
It will take 2-3 days to get the marriage certificate if I am right.

I fly back to London for work on Jan 28th. I was intending to do the application as soon as I've got the marriage certificate. So that could be while I am still there, or it could be when I am back in London

-

For Financial requirements I meet the income level and I have 6 months of payslips and bank accounts to show the wages are going into that account.

-

As for Appendix 2, do you know the link where I can actually print this?

When you say not more then 28 days, does this include weekends? or general days?

Are these the Appendix 2 documents, which ones specifically?

Also isn't this me, the person who sponsoring the other person to come to UK to fill these in? This looks like the other person who wants to come to the UK has to fill this in, but how will she fill in all the information as this is for me, the UK based person to fill in right?

The order of the visa application process for me to sponsor my wife

Post by ukbusinessworker » Sun Jan 13, 2019 1:27 pm

Guys I am getting alot of conflicting advice and no one is just answering my question.

To start with, I just want to know the order of the application process. I am the UK citizen, my fiance who I am marrying at the end of the month is in India and is an American citizen.

Can someone please confirm this order listed below is the way it works?

1. Once we are married, and I have the legal marriage certificate, I go online to the GOV UK website to make the application for her. Me, as the UK citizen that is sponsoring her to come t the UK on a Spouse/Family VISA. In this moment of the application, I will also have to pay the online fee's.

Is this right?

Yup.

https://assets.publishing.service.gov.u ... -08-18.pdf

The applicant completes the ENTIRE application, but will need info from you. When asked about applicants' parents etc... they are asking about your wife's details. You are the sponsor. She is the applicant.

I am not familiar enough with the application process from India to comment about the biometrics etc... questions that you have. Info should be found:
https://www.vfsglobal.co.uk/in/en/how-to-apply

Also - I know you've said your fiance is a US citizen. Does she have a visa that allows her to reside in India (not just a visitor visa?)?

Yes she has an OCI. That is the lifelong visa that people that belong to Indian heritage can get if your outside of India.

So she has that.

And her nationality/passport is American
