ILR queries

Post by nsf31 » Thu Jan 03, 2019 9:34 pm

Dear All.

I'm due to apply ILR soon under Tier 2 (5 year route) and am planning to apply by End April 2019 for my ILR.

I need to check few ILR queries -

1. Are PSC centres still open and can ILR one day in person appointments still be booked? Or are the new UKVCAS centres the only option?

2. What's the fastest route of applying for ILR?

3. Can I apply 10 days before my 6 years Tier 2 visa expires?

4. I also have to travel to my home country in the last months before my 6 year tier 2 visa expires and will return back 10 days before my tier 2 visa expires (6 years on tier 2 visa). I will aim to return back and immediately apply online for ILR. I will save changes from home country and keep documents ready before I leave for home country from UK.
Please let me know if this is fine?

5. If I'm travelling to home country and to UK back in last month? Am I risk at being denied entry at airport if I'm arriving 10 days before my 6 year tier 2 visa expires?

6. In new visa system of UKVI what's considered as date of application? Is it the online date of application or is it the date an appointment in the sophia sephora centre which is considered as date of application. I'm just checking this as the visa expiry date will be very close.

Thanks in advance..

Best regards.

3. Can I apply 10 days before my 6 years Tier 2 visa expires? you can apply anytime before your visa expiry

Why do you have to wait for 6 years? You are eligible after 5 years on Tier 2 or is there any other absence issue?

Thank you for your reply.

Please can you clarify point 6? Is the date you submit the online application.

Please can you answer question 5.

Yes it's urgent family member health issue.

I'm switching from tier 2 visa from one employer to new employer and will start with new employer on salary at correct salary threshold (greater than 36k).
I was on less than 35k with old employer.

Please can you let me know.
Thanks.

yes the date of online application submission will be the date of application

Well technically you will have valid visa to return to UK so no issues. Its upto immigration officer what questions IO will ask you. You should keep all documents ready in handy I would say so you can explain you had to travel in emergency and will be applying for ILR soon. As per my personal experience, I avoid travelling close to date of visa expiry as IO grills you with more questions at the end of your valid leave. So if you have an emergency and you have to travel for sure and is absolutely unavoidable, then really you dont have any option. Just be well prepared to answer all questions as most likely you will be grilled more at the airport immigration.

Thanks that's great.

I was planning to carry all my documents with me and happy to answer any questions to the Border officer.

Last few questions -
1. Do you think the UKVCAS centre appointments should be available quite quickly after submitting an online application considering it's post brexit time?
2. Any impact you anticipate about brexit on Visa rules or application processes?
3. Any pertinent rule change you are aware of impacting switching of tier 2 visa to ILR coming anytime soon or after April 6th 2019 (usually when rule changes apply)?
4. And any other risks you think are involved in this matter besides which I have already asked?

Thanks once again for answering queries highly appreciated.
Best wishes.

Brexit has nothing to do with and no impact on UK immigration applications and rules. I cannot understand why members think this. It only affects eu citizens and their family members.

1. Do you think the UKVCAS centre appointments should be available quite quickly after submitting an online application considering it's post brexit time? usually you get free appointments within 5-7 days but you can get same day or next day appointments if you pay more

Thanks you for your reply.

Another question
If we have done bank work for few hours with our same employer (PAYE job within 24 hour limit abiding by all rules) in one year of the 5 year period of ILR. Do we need to declare this in our ILR application? If yes what documents do we need to submit?

ILR Queries

Post by nsf31 » Fri Feb 15, 2019 11:28 am

Hi there,

I had one query - I have just moved job from one sponsor to another.,

I have been with the current (new) sponsor for less than one month. However once I get my first payslip I am going to apply for indefinite visa Tier 2, 5 year route. However my tax code has not been added correctly by the new employer HR - would this have any impact on my ILR application?

I will be submitting my employment contract, my first payslip and a letter from employer stating my annual salary (which is >36k). The above 3 documents will reflect my annual salary.

Is this a problem - if my first monthly salary is not going to be the full amount (and its got wrong tax code) so will be even lesser . I will be submitting bank statements also for last 3 months.

Let me know your thoughts?
Best wishes,.
Sherron
