ILR for Spouse - Please Help!

Dear All,

I am wondering if I can seek some expert advice from you please. I was on Tier 1 (General) visa when I got married in Jan 2014 & applied Tier 1 (General) dependant/partner visa for my husband who joined me in the UK in March 2014. His initial visa granted in India was from 27/02/2014 to 11/06/2016. We then applied his extension of Tier 1 (General) dependant visa using PBS dependent extension form which further granted him leave in the UK from 31/07/2016 to 31/07/2019.

Under the 5 years' rule, my husband has now successfully completed his 5 years stay in the UK & ready to apply for ILR. Just to clarify that I, the main applicant, was granted ILR on 3rd June 2016 & based on that applied for my British nationality in April 2018 & now hold a British passport. My questions to experts are as follows please:

1) Am I correct in assuming that we need to submit ILR application using SET(O) form given that my husband received his first Tier 1 dependant visa when the main applicant was on Tier 1 (general)

2) I understand that SET(O) ILR can now only be completed online. However, there are only 7 sections/stages when I tried to start the online application for my husband. I remember when I applied (paper style) for mine, it took me to various sections i.e. how many days I was away in the last 5 years, my employment, my income, my savings etc. the form was literally 80 pages long however the online application is only 7 sections with very basic information asked. No information asked as how many days my husband was away from the UK, his employment, his salary.... Is this something new? Infact the 7 sections hardly asked information about the main application other than my passport, NI etc.
Am I on the correct online form? Is it actually NOW only 7 sections for dependents? or when you submit a detailed application form is generated???

Please may I have some help here kindly?

1. It is form Set(O) correct. He doesn't qualify for ILR yet. He can apply no sooner than within 28 days before 27 February 2019. Don't submit and pay too early.

2. There is no requirement to complete all the details that YOU needed for ILR. YOU are not applying so only information relevant to your dependent must be entered. Your dependent is the MAIN applicant for ILR.

You are right, I was aware of the 28 days rule but only wanted to start the application to ensure we were ready with any requirements or with the online application. We wont be applying/paying until March this year but again thank you for the heads up!

I understood your answer to point 2 as well, the old ILR paper style form used to ask funds & how many days out etc. for dependents as well (if I remember correctly) therefore I was paranoid why online version isn't asking any such information for my husband now. I will carry on & continue the online form as normal

One last question, if i may please - When I go to pay for the fees, do you know if it gives me option to opt for premium service? We would like to go for premium service

We wont be applying/paying until March this year but again thank you for the heads up!

No need to wait till March, apply within 28 days before 27th February if you wish. Be mindful of ILR fee increases, sometimes they happen earlier than April.

There is NO absence limit for PBS dependents with visas issued BEFORE 11th January 2018. There is NO funds maintenance or financial requirement for ILR based on PBS Dependent route.

One last question, if i may please - When I go to pay for the fees, do you know if it gives me option to opt for premium service? We would like to go for premium service

There is no longer a same day decision premium service. The premium centres have closed. You apply online and can select the new service through UKCVAS if you wish to. See link below.
