Set(O) or Set(M) for wife's ILR application

Post by pavsri » Sun Mar 10, 2019 12:11 am

Hi All,

I have a question about my wife's and son's ILR applications.

My VISA timelines are below:
====================
Entered UK in December 2008 on Tier-1 General visa
Received ILR in December 2013
Received British Citizenship in Feb 2016

My wife's VISA timelines are below:
==============================
Entered UK on Student Visa valid from Sep-2008 to Jan-2010
Was on Post Study Work visa valid from Nov-2010 to Nov-2012
First Tier-1 Dependent valid from Jan-2013 to Dec-2013
PBS Dependant extension from Dec-2013 to Dec-2016
Current PBS Dependant from Dec-2016 to Dec-2019

My son's VISA timelines are as below:
================================
Born in India in May-2012
First entered UK on visitor visa valid from June-2013 to Dec-2013
Received Tier-1 Child Dependant visa valid from May-2015 to Dec-2016
Current PBS Dependant from Dec-2016 to Dec-2019

My wife has completed her 5 years stay in the UK on Dependant visa but my son hasn't yet. Is my son eligible to apply for ILR together with my wife this month?

Please confirm if my wife and son should use Set-O or Set-M for ILR application?

Thank you for your advice

Many Thanks
Sri

Definitely not the SET (M) form which is for the spouses of settled persons (non-PBS) who have completed their 5 years.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Yes. Complete one form SET O and include child as dependent. Wife is main applicant.
Char (CR001 not Casa)
