Spouse/Fiance VISA for Turkish Businessperson

Post by RichTRemix » Fri May 31, 2019 4:07 pm

Hi.
I am a British Citizen and wish to marry my Turkish girlfriend who is currently in the UK on a Turkish Businessperson VISA. We have been together 12 months and have lived together for the past 5 months.

Her current VISA runs out at the end of October 2019 and she is worried that the home office will deny her application for a Spouse/Fiance VISA as her business is currently not meeting targets.

Also, I am in full-time employment and meet the minimum required for sponsorship but have only been with the company 2 months.

I have searched for posts on the forum and all over the internet for advice and people in a similar situation to no avail.
Is it possible to successfully apply for a VISA for us to be married and could somebody please explain the difference between the 2 VISA's if indeed one of these would be what we need?

There are a view other details that i'm concerned about but this will do for now

Many Thanks. :)

Irrelevant. Two different visas and rules completely. Neither dependent on the other. Presumably the visa was issued for more than 6 months?

Were you working elsewhere prior to this employer??

Note that you can only apply for a Fiance visa from abroad. You cannot apply for it within the UK. Also note that she will not be permitted to do ANY form of work on a fiance visa. If you marry before her visa expires, she can switch to a spouse visa within the UK before current expiry.

Note that the Fiance visa from abroad costs £1523. Only your income counts for this one.

A Spouse visa within the UK costs £1033 plus £1000 Immigration Health Surcharge. Combined income or either of your income counts for a spouse visa.

She needs English test and evidence of meeting the financial requirements for a minimum of 6 months.

If either of you or jointly have 6 months old savings of at least £62500 anywhere in world then may be able to meet the financial requirement without employment.

Hi. Thanks for your prompt reply.
Yes, her current VISA was for longer than 6 months.
I was unfortunately in prison for 4 months (first time conviction on self defence + bad solicitor and false witness statements = prison but won an appeal and got released LONG VERY SAD STORY) she stuck by me after only meeting a few months prior because she's an amazing woman and could tell i'm not that type!!
I was full-time employed before that and upon release i worked at my current position through an agency (3 months) before gaining contracted employment.

So can we get married on her current VISA? And then get a Spouse VISA after?

Her English isn't an issue at all due to her employment in Turkey. She also has a degree in Business Administration though I realise that may not be comparable to a UK Degree.

Yes you can get married by flowing the process of giving notice at an HO approved Registry office and waiting for ho approval to marry.

You will need a minimum of 6 months payslips and bank statements fron your current employer to prove you earn a minimum of £18600pa.

Yes, 6 months payslips, 6 months corresponding bank statements and employer letter.

If she applies for a spouse visa after youarry within the UK, she can use her income as well or your joint income.

Thank you so much for your help.
Is this before tax and deductions or after?

Before any tax/deduction. Also you or your partner can use their savings too
