Your situation is the same as my wife. As I understand it, you need only send either your passport or VALID BRP. As you are applying for pre-settled status, the requirements are different from those applying for settled status. As stated on the application form, evidence of your permanent residence card is needed along with the applicants passport. We only sent just my wife's passport and a copy of mine. (British citizen). I have already called the resolution centre and they confirmed I did not need to send my wife's BRC. It also states, that if you have a valid card, you do not need to give biometrics again. But not too sure on that one. From others on this forum, it seems like we all have to give them again. So presumably, we will be issued with another BRP. I will know more once the Home Office replies to our application.
The above is presuming you are applying from within the UK and are married. My wife missed 2 calls from the Home Office, yesterday and today. The caller said that she was responding to my complaint and asked her to call back. I called back today and asked for the person who had left the message. The call handler said that they had never heard of that personShe asked for my wife's reference number so she could check on the system. I told her it was a Surinder Singh application, because it is on a different computer system - not the system the EU Resolution Centre staff mainly access. She went off to check on the other system. She came back and said that my wife has been granted ILR and will receive her Biometric Residence Card within 10 days.
She has not yet received a Certificate of Application or a letter confirming the granting of ILR status, but I will update if any of these are received and when the card arrives.
I hope everyone on this forum will receive their status as soon as possible.![]()

You don't need to show that the British citizen is exercising or has exercised treaty rights in the UK for Surinder Singh pre/settled status applications. Makes me wonder how the only member here to get a decision was dealt with so quick.
I think the member was one of the first to apply for the paper application, they received their biometrics letter a week before everyone else then received their settled status last week, maybe we will get it sometime this week or next?
