FLR M Application for spouse

Post by Ignito1 » Thu Aug 01, 2019 4:06 pm

Hello Members,

I need some advise as I am filling out my wife FLR M application. Last year I got my ILR approved through Tier 1 Entrepreneur route and now my 2 year old son also holds a British passport. I am working full time now in a different company and my company who I am still a director is also active as mostly I have outsource most of work to other companies.
In the FLR M application there is a question in which they ask you about if you are a director of any company and in my case I am so which documents I need to send with my wife application?

I have already taken a employment letter from my current employer and also have 7 months of payslips and also have contract of employment and my salary is well above the £18,600 threshold.

Please let me know which documents proof I need to submit being a director of Limited company?

Many Thanks

Not sure if FLR(M) is the right form for you if you got your ILR through Tier 1 and if your wife had dependant visa as Tier 1 Dependant then I believe you should complete Set (O). And I am also not sure if your wife is in the UK or back home. But i can be completely wrong. Please wait for other senior members to check this post and seek their advice.

To answer your question:

Although you are completing the form, the question is being asked to your wife and not to you. So the question to your wife is "Are you a director of a company" and if she is then you should answer yes. If she is not, then answer no.

This is what my understanding is.

I'm not an expert, but when my husband was filling out my FLR(M) application, he declared was an employee from one company and director from other two. However, he only chose one company to rely on (the one that met the criteria the most), and he submitted exclusively the financial evidence from that company. When we applied for the visa, the financial evidence did pass.

Just to clarify something, the threshold in your case is £22,400, as it counts as 1 child in addition to the partner. It doesn't matter whether your child is British or not, that's your current threshold.

As far as I know, this is incorrect. The financial requirements rely on the sponsor (that means you, not your wife). You have to respond as the sponsor. You must be able to provide evidence of your finances as an employee, company's director, academic grant, savings, etc, to meet the minimum income. At least that's how we filled in my application.

If you were granted ILR under the 5 year route, your dependants should continue to extend their current visas. If they apply under FLR(M) this will re-set the time spent under the PBS dependant category to zero, putting them on a new 5 year route to settlement (ILR)

They only need to switch to FLR(M) if you were granted ILR under long residence
.
(Casa, not CR001)

OP appears to have applied for ILR based on long residence.

Preferably only use your employment to meet the financial requirement. You can even leave to give your directorship details if you wont using that route.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
