Married for 12 years and have Son but lived outside of UK

Post by nikkd » Sun Sep 01, 2019 10:47 pm

I have lived in Thailand for around 17 years with my Wife. We have been together in a partnership for nearly 17 years and have been married for 12 years. We have a 15 year old son who has dual nationality. He is currently in School in the UK. I have moved back to the UK with him last year while we sell the house in Thailand. We have now got a buyer and the house sale is going through.

I want my wife to come to the UK on a settlement Visa but I have read that we need 62,500 GBP's in the bank for 6 months to show we have enough money because. Has I am not yet working here. (Not really possible to work in the UK just yet as I am still traveliing back and forth to sell the house and arrange belongs to be shipped back to UK) but don't see any problems with finding work here in the future.

I have enough money in the bank but it has not beein in there for 6 months yet as it's partly from the sale of the house.

My Question:
Is it worth applying for a settlement Visa now for my wife if the funds have not been in the bank for 6 months?

Cash savings from the sale of property is not required to be banked for 6 months. You can use these funds straightaway to meet the financial requirement under cash savings. You need to attach following proofs:

Land Registry information or documentation (or a copy of this) or its overseas
equivalent.
• A letter from a solicitor (or other relevant professional if the sale takes place
overseas) instructed in the sale of the property confirming the sale price and other
relevant information.
• A letter from a lender (a bank or building society) on its headed stationery regarding
the repayment of a mortgage or loan secured on the property.
• Confirmation of payment of taxes or professional fees associated with the sale.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

I appreciate your advice, Are you 100% sure about this? Are you a lawyer.? I don't want her to fail the interview as it's so expensive.

Page 54 point 7.4.10 onwards of Appendix 1.7 explains it clearly.

Thank you very much, you have saved me. I lost the link to that PDF last night and couldn't find anywhere, so thanks again
