I read guidance given on the website related to the child visa and my understanding was that a child is eligible to settle in the UK if at least one of your parents has indefinite leave to remain or proof of permanent residence.
I am going to apply for ILR at the end of August and ILR DEPENDENT for my wife. My son is born outside UK. Can some one confirm me whether I can go for Settlement for my son or not?
My son is 16 months old..
It applies when either parent does not have a limited leave to remain visa and it does also say MAY and not definitely yes. As your spouse is applying for a spouse visa, the child follows the same path and ilr as the spouse. The reason for this question was I read in the FLR m guidance that the following person cannot use this form
"As the partner of a person granted indefinite leave to remain in a work route, if you are currently
in the UK as their dependant. See our website for further details: https://www.gov.uk/visas"
Can someone clarify the issue?
