Help my legally 10 year is completed, can i apply ILR ??

Post by jyotiuv » Mon Sep 23, 2019 9:07 pm

hi all the members please help me,,I have been in uk legally for 10 years since August 30 2019, I am currently on spouse visa which is expiring on August 2020, I was tier 4 student before I switched my visa to spouse. Can I apply for a ILR on 10 year route rather than waiting for another year and having to show income proof as it will be a lot easier. I have married to British citizen and have a baby who is 4 already...what kind of supporting document will I need, please give me some suggestion.

All visa count for long residence. Presumably you meet all the requirements.

Thanks for the reply, I was just confused as when i went to fill in the application it was telling me that i should not apply for 10 year route ILR from spouse visa, if i am on spouse visa as i should be applying on 5 year ILR route, but my 10 years finished before the 5 years and it seems like an easier route to go rather than gathering all the self employment documents together...

I have already passed my life in uk test and have my english test at weekend so on 10 year route i can just apply asap.

If i wait for spouse 5 years ILR then i have few months to go and have to submit financial information again, just want to be sure before we spend 2400 to be told we applied wrong route thanks

Tier 4 to FLR-M to ILR on 10 year long residence?

Post by jyotiuv » Thu May 14, 2020 1:14 pm

Hi respected members i am in need of some expert advice,

I come to the UK on tier 4 visa, since then i got married to a British citizen and switched to FLR-M and we have a 4 year old British son, i am currently on my final spouse visa that is expiring the end of august but due to covid-19 my husband has not been working...
He has met the financial requirement for my ILR in August up to April 2020 as he earned £20,000 as CIS construction worker after tax but we cannot give the last 6 months wage slips as he has been home since the middle of March...

Now as i have been in the country legally for 10 years 8 months without a break in any visa can i apply ILR through 10 year long residence?

If i can apply 10 year long residence.. over a year or so ago i had a debt relief order as i couldn't pay my debts on credit cards as i was at home with my child and only working 1 day a week so my credit file is still showing DRO and CCJS although the DRO has settled, Will this affect my application for ILR?

Thanks to everyone who can advise

Yes as SET(LR) has no income requirement. Personal debt is a civil issue not relevant to ILR

Ok thank you zimba we have had the application filled in for a few weeks but was to scared to submit it as our solicitor told us its only a 50/50 chance to get ILR accepted on long residence as compared to waiting till August with the final 5 years FLR-M transfer to ILR was rather worried about the situation regarding wage slips but if we can safely submit now we will go ahead thank you so much :D

ILR Submitted stuck on UKVCAS document upload

Post by jyotiuv » Mon May 25, 2020 4:46 pm

Hi all i have submitted my ILR 10 year long residence application but i seem to be stuck on uploading my documents as i cant seem to find any guidance on what categories my documents and evidence should go in.
Categories are as follows:

DOCUMENT TYPE
Other
Residence in the UK
Finances
Proof of business
Life events
Medical Information
Sponsors / Employment
Proof of identity / Travel History
Educational
Proof of application

Now i am currently on spouse visa but have been in UK for 10 years 8 months so applied via long residence route.

So i need to submit the following documents in support of my reason to stay in UK with my husband and child.

Marriage certificate
British husbands passport
British sons passport, birth certificate, attendance letter from school
My passport
Old passport and copy of entry clearance on tier 4
My BRP
Council tax bill with both names for 2020
Water bill with both names for 2019
Letting agent letter stating rent increase with both names 2020
Letter confirming employment as key worker
English B1 certificate
Life in uk test

Please could anyone give some sort of explanation to what categories i need to upload them as i don't want to place them wrong and loose £2408

THANK YOU

Most of the documents are NOT require.

If only you are applying for ilr based on long residence, you ONLY need passports, most recent brp card, liuk and English requirment. Nothing else.

You don't need address proof, spouse passport, marriage cert, child's documents or employer letters etc.

I think the list is generic which asking extraneously required documents as only passports, BRP, liuk test and B1 are only needed.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Long residence is granted to an eligible individual ONLY and there are NO dependents. You are expected to meet the requirements on your own. YOU DO NOT NEED anything to provide regarding your spouse or children. Their status is NOT RELEVANT at all. Your relationship with them is NOT relevant under long residence. The doc list is generic and inaccurate

Sorry for duplicate post but this is confusing me when there asking for more

Ok on the ILR application it asked for any reasons why i should stay in the UK so i completed this section with the following:
My husband is a British citizen and we now have a 4
year old son currently in school, I have a-lot of ties
here not just with my husband and my son but his
entire family, our friends and community, i also work
in a local care home looking after elderly and
vulnerable people.

at the next section it states i should supply supporting documents as below:

Evidence you have to prove the relationship
with Mr A***** A***** (for example
marriage certificates), and correspondence
addressed either to you jointly, or in both of
your names, or addressed individually to you at
the same address, to cover the last two years.

Proof of Miss Z****** Z******
relationship status as the married or civil
partner of Mr A****** A******.

Evidence you have to prove the relationship
with your child / children (for example full birth
certificates)

Document(s) showing your child / children's
immigration status such as passports, biometric
residence cards, or vignettes

Document(s) showing Mr A****** A******
immigration status such as a
passport, biometric residence card, or vignette

Documents supporting my other reasons to stay
in the UK

The passport issued by Nepal for Miss Z****** Z******

Current Biometric Residence Permit Miss Z****** Z******

All previous passports, travel documents or
national identity cards that you have used to
travel to or remain in the UK

So i am very confused now :(

The reasons to stay question is NOT mandatory.

The checklist is generic!! The checklist is NOT the immigration rules or the official set LR guidance.

No,you do not need to submit a whole bunch of unnecessary documents. HO do actually know the rules and requirements for long residence ILR.
