Dependent visa extension for ILR

Hi ,

Request the following information:

I recently got my ILR in Feb 2019 (Tier 2 General route for 5+ years ). My Wife is currently on PBS dependent visa which is valid until Nov 2019 ( She will be completing 3 years and 4 months by Nov 2019 ).

Can you please advice what is the visa type I should I apply to extend her dependent visa?

If I understood correct, you got your ILR via Tier 2 G 5 year route?

Your wife needs PBS dependent extension till she reaches 5 years to qualify for her ILR.

She applies for a PBS dependent extension as advised. It will be a 3 year visa extension. Visa fee and £1200IHS is payable.

You need to prove 90 days maintenance funds of £630 and also two years evidence of cohabitation.

That is correct. I got my ILR thru Tier 2 G - 5 Year route.
And need to apply extension for my wife who is in the UK only for 3 years now.
As I am not in Tier 2 general anymore, I am not sure which dependent visa should I apply to extend her stay.

No. Keep her on PBS dependent visa till she qualifies for ILR after 5 years regardless of your citizenship.

If you change her visa to spouse visa her ILR clock will reset to zero and she will have to stay another 5 years on spouse visa to qualify for ILR.

Visa Expires in a Month.

Hi,
I got my ILR last Feb 2019.

My wife's dependent visa and my Sons dependent visa is expiring by mid Nov-2019.

My Son was born in the UK , but he had an Indian passport before and I have now applied Citizenship registration for my Son a month back. It seems the process can take up to 6 months to get the decision/confirmation. Does my son need to have any clearance or letter to stay in the country until we receive the decision?

Similarly, for my wife, I have applied for PBS Dependent Visa extension a week before. And her visa expires by Mid November.
The process syas, it can take up to 8 weeks to get her visa/decision.
How does it work for the dates after visa expiry, until we get the new visa?

please clarify.

1. Non-issue regarding your UK born child. He does not need a visa.

2. If your wife applies in time before visa expiry, her existing visa conditions continue under section 3C of the immigration rules while HO processes the application.

3. Please do not start new topics with similar questions.

Apologies for not being clear, My son had a dependent visa as well before and it is expiring by Mid November.
I have now applied ILR for my Son. I suppose he is also covered by Section C as you mentioned.

No he is not covered by section 3C as it does not apply to citizenship applications. It is only applicable to immigration applications.

Huh ! I should have explained this before.
My Son was on a PBS Dependent Visa and it's expiring by Mid Novemeber.
He was born in the UK. But I did not hold an ILR Visa during the time of his birth, so I had to apply a dependent visa for my Son as I had to travel to india and the visa is expiring by mid-November 2019.

In between, I have got my ILR . so I have applied for citizenship registration (Standard) for my Son last month during mid october 2019 ( which is a 6-month process ).

As you said, he is not covered by Section 3C, can you please clarify me what will cover him legally to stay in the country as he is already on PBS dependent visa . Is it more than enough that he is a UK born child ?
